Dear Mr. Spitzer:
I am very concerned that an attempt was made against my life and nothing was done about this crime.
When I ask local authorities about this they tell me to talk with lawyers, but lawyers say that they cannot help me against the District Attorney's office.
I sent a letter like this to Stephen F. Lungen, District Attorney, County of Sullivan, Monticello, New York, but I never received an answer from him.
My explanation below, and the enclosed subpoena documents should help explain my very real concern.
I am an immigrant from Poland. I received no help from local authorities in this matter. Local authorities have thrown me in jail many times with no good cause, and have called me filthy names and a "communist."
In fact, I fled Poland to avoid communist oppression many years ago.
It took several years for me to obtain the Information documents I enclose. I had asked about them many times but was told each time that they did not exist or that the case had gone away.
I also received a subpoena to testify before a Grand Jury about this matter, how my neighbor, James D'Ambrose, a friend and crony of local authorities, had shot at me. The Grand Jury investigation never happened, and I was never asked to testify about what happened at all.
Mr. D'Ambrose had been harassing me for years by filing complaints against me. These were frivolous and simply dismissed, but I was often thrown in jail. Finally, he tried to kill me with his shotgun. The enclosed subpoena documents were filed against him for this, including for felonies and misdemeanors. I now understand that D'Ambrose was allowed to plead guilty to the least serious charge.
The felony charge of 1st degree Reckless Endangerment for shooting at me was dismissed. Mr. D'Ambrose was allowed to move out of town. I would like this case to be opened against D'Ambrose for at least the felony charge, if not for attempted murder. If this can't happen, then I would like to know the circumstances of why this very dangerous man, a friend of the local legal authorities, was allowed to get away with attempted murder with only a slap on the hand, and with no testimony or other input from me.
I especially think this should happen for the following reasons:
∑ D'Ambrose did not just "shoot within 500 feet of a dwelling." He shot directly toward me with a 12 gage shotgun and, even according to the information, penetrated the front tire of my tractor less than three feet from where I was sitting, putting me in grave risk of death.
∑ The investigator who signed this most serious subpoena information, Geoffrey Cabrera, told me that D'Ambrose admitted to trying to kill me. Cabrera asked D'Ambrose why he did this, and D'Ambrose gave him "twenty reasons" why he tried to kill me.
I think Cabrera would testify about this and can help put a very dangerous man in jail, where he belong.
Please consider causing this case to be reopened, because I do not think justice has been done, and I do not think that the people are protected when very serious charges are dismissed. If you cannot do this, please help me understand how this can happen in a society where local authorities should protect even immigrants like me, and even against their friends and cronies.

caused Kulon to be falsely accused, prosecuted, imprisoned, tortured, threatened with death
and be a victim of an assassination attempt on his life.

The local wisdom has it that Detective F. Sticco, with the help of his friends: local judges,
including Hon Keith Zanetti and District Attorney Assistant B. Mitzner,
hired a man to shoot Kulon.
Fortunately the would be assassin missed his target.
The following to your attention the artist painter, an immigrant to this country, needs help with a serious matter,
which just does not fit well with obvious avenues of help,
such as seemingly appropriate civil rights organizations, watchdog groups,
federal and state offices; and the like. He has tried, but receives, at most, only form letters in return.
These usually say that the matter is of a type the organization does not deal with,
or they suggest that he should hire an attorney.
However, he cannot afford to hire an attorney capable and sophisticated enough to solve that problem.
It seems that someone or some organization ought to be as angry as he is about the following,
and might offer to help.
Franciszek C. Kulon is a painter and an immigrant to this country.
He studied painting in the traditional manner in his native Poland , and became well known there.
He has a free soul and could not stand the oppression he experienced under the communist regime,
so he came to the United States in search of an opportunity to earn and live a free life.
He was well on his way, until he came to live in the small town of Parksville , in Sullivan County, New York.
There, Kulonís life has been threatened, his property placed in jeopardy,
and his rights as an artist under the First Amendment have been trod upon at the whim,
and to the perverse pleasure of,
members and friends of the local legal community. What happened here should not be allowed in this country.
When Franciszek Czeslaw Kulon came to Parksville, he bought an old house in disrepair.
He worked hard on it and it now serves as his home and studio.
Buying this house caused him to run afoul of Jeffrey Altbach,
a local general practice lawyer and Justice of the Peace, who had personal interests in the property.
Altbach, through his friendship with various locals, soon caused Kulon to be falsely accused and prosecuted,
imprisoned, physically mistreated, attacked, and threatened with death.
At the same time, Kulon began receiving many offers and suggestions that he should sell his house.
In hindsight, Kulon believes that he knows what was happening, and who was behind it.
Altbach wanted Kulonís property, and wanted him out.
Kulon fought back by first seeking help to no avail, and then using the only power that he thought he might bring to bear:
He used his brush to make his persecutors, especially the public figure Altbach,
satirical subjects of some of his paintings.
Altbach's response was immediate, relentless, and harsh.
He sued for $1,500,000.00 over Kulonís painting "Our Honorable Judge of Liberty ,
" which portrayed Altbach as a smug devil sitting with his law books.
But this is how Kulon remembered Altbach, after he had local police officers break into Kulonís home,
drag him to Altbachís office, and cart him off to jail even though this "Honorable Judge"
was not legally empowered to do so.
Kulonís painting was temporarily confiscated, and injunctions were issued to keep him from displaying this work.
He was held in contempt of the order by Sullivan County Judge Anthony Kane,

At the hearing, I will try to save my house, with its studio and art gallery. I believe that three or four lawyers will attend on behalf of Sullivan County.
This hearing should be very interesting. I again invite you to attend and see Sullivan County "justice" in action.

I received this link to the Sullivan County Tax Foreclosure Auction website today from a real estate... The link shows that my house is now for sale and is being shown online by the county. It asks people to place bids online or in person. It has a picture of my house and it allows people to download a brochure and other information about my house. A real estate lawyer or person called and told me that if anyone places a bid, I would lose the house unless I was the highest bidder at this auction.
This seems completely against what the judge ordered: "ORDERED, that until further order of this court and pending the hearing and determination of this application, all proceedings and execution relating to this action as and Franciszek (Frank) Kulon (SBL: NE29-1-6.5), including but not limited to showing or selling the property known as 596 Arden Hill Road, Parksville, NY 12768, be stayed."
I am very worried about this. Is this not contempt of court? Can anything be done about this? Please check the link and let me know what you think as soon as possible. The link should go right to my house auction with a photo of my house, but sometimes it just goes to Sullivan County. If it does not go directly to my house auction, then use 596 as a keyword.
