If the woman is tried and convicted for murder after Mr. Gentry passess, it's still the same result. Unless Mr. Gentry is a key witness to the crime, he won't even be called to testify during a trial anyway, therefore the proceedings can occur without him being present.
It sounds as if there is a dearth of evidence and typically, the state won't go to trial unless the prosecutor believes a particular case is airtight.
