AG says grand jury can get opinion through the county

There are 19 comments on the The Ukiah Daily Journal story from Sep 6, 2010, titled AG says grand jury can get opinion through the county. In it, The Ukiah Daily Journal reports that:

While the California Attorney General's office says it cannot help the Mendocino County Grand Jury directly with a legal opinion about whether or not DA Meredith Lintott has the option of taking no action on their demand to get Supervisor Kendall Smith to repay travel funds, there are other ways to get an opinion out of them.

Smith should pay back the money period. Someone needs to watch our money better. Just don't take someone word. All money spent must be approved.

Smith is only out for herself, and when she is joined by Dan Hamburg they will be like two peas in a very crooked pod. I can't believe we are going to elect Hamburg after he cheated his marijuana growing employee. How honest or careful do you think he will be with the public's money?

Oh, really? I had not heard or read that Hamburg had been indicted, tried, and convicted of cheating an employee. Do you have evidence, or are you parroting hearsay and gossip?

Nothing like passing the buck.
If Kendall had any integrity she would have just paid it back. Afterall, originally she was just an ordinary Mendo County employee years ago before she decided to rise to power.

Why don't people get behind a write-in candidate with some integrity and everybody just write them in. So who wants to run? There is still time to pull this off in the election.

I don't know Smith, but please, just pay the money back and put an end to it!
The county has idiots who make more than 50K a year, why is the GJ so anal on Smith?
Is it to show everyone how powerless they really are......Come on let's move on.

In my disgusted opinion this expensive lawyering double-talk is filled with knotty NOTS & CANNOTS.

The State AG CANNOT issue an opinion.

County Counsel Nadel CANNOT & WILL NOT say anything.

DA Meredith Lintott said she had the discretion under the law NOT to do that.

Smith says she CANNOT pay because she didn't do it.

It is NOT certain whether the Sonoma County Counsel will deliver a knotty legal opinion filled with stunted legal double-talk.

All of it a glaring example of DOUBLE-TALKING LAWYERS SUCKING UP HANDSOME SALARIES at public expense.

This should be a wake up call to people

Smith not only lied and stoled from us, now she's got her nose straight up in the air along with a certain finger, to all of us
She's cruising on her magic carpet funded by the taxpayers and looking down at all of us, untouchable. And smug about it
If people don't wake up after this situation and start supporting better candidates, we're all in serious trouble

Lying to the people who pay you is bad enough
Stealing from the people who pay is bad enough

But sticking your finger up to those people when they catch you and want their money back, while still being on their payroll?
That takes an arrogance of enormous proportions
Amazing that anyone still supports her while she steals their money, snobbishly refuses to pay it back, and still gets her paycheck from them

Let's try to make this simple ...
Lintott refuses to take legal action against a the supervisor because she is a Fort Bragg ally. Multiple grand juries have NOT trusted Lintott's legal advice on this topic and want somebody -- anybody -- to tell them if Lintott knows what she is talking about. Meanwhile, three years into this boondoggle, Lintott suddenly realizes that there is an upcoming election. With no apparent authority to do so, Lintott tries to save face by ordering the auditor to start docking Smith's pay to recoup the alleged travel reimbursement overpayment. Like the grand juries, the auditor also does NOT trust Lintott's legal advice and wants somebody -- anybody -- to tell her if Lintott has the authority to deny due process by taking money by the mere stroke of a pen. The local county counsel does not want to touch this tar baby and punts to the Sonoma County Counsel. Stay tuned for more breaking news (breaking at the pace of a snail crawling from Ukiah to Santa Rosa).
Does anybody have to wonder why there's not enough money for basic services? What a colossal waste. If Lintott has the authority to simply make an order to dock Smith's pay, why didn't she say and do so three years ago and save us all from this BS? I personally want a DA to be decisive and mostly right. No way that describes "blowing in the wind" Lintott, which means I'm voting for Eyster. Like the grand juries and the auditor, I no longer trust that she knows of what she speaks. Time again for a real DA.

It seems to me that this is the kind of financial malfeasance that likely caused Lintott to file personal bankruptcy and lose her Fort Bragg house. She's been messing around with this Smith thing for years now and has yet to get it right. Her failure to act and indecision is costing us big bucks. I've been told that Lintott could have asked the Attorney General for advice way back at the beginning but apparently she doesn't want to help the grand jury or hurt her friend. I personally believe that Lintott has been responsible for bringing the bad side of politics into the DA's Office, an office that is suppose to shun politics in its pursuit of justice. I'm ready for change and I hope everybody else is also. I'm also voting Eyster.

Controller Ford CANNOT - NOT PAY Smith because Lawyer Lintott's lawyerly discretion is NOT definitive enough in a legal sense.

Lintott says she has the DISCRETION as a licensed lawyer & public prosecutor to either pay or not pay Smith. Such legal blathering about discretion confuses Ford who wants to proceed legally under the law, whatever that is.

A lawyer in a pretentious black bathrobe, HIS HOLINESS -THE JUDGE, has all kinds of legal DISCRETION to mystify & confuse the public who pay his/her enormous public salary.

USING YOUR DISCRETION;
CAN YOU SEE WHO IS MILKING YOU EVERYDAY AT THE PUBLIC COURTHOUSE?
