Sevier citizens sue government

More concerned citizens join the rank and put their words into action!

East Tennesseans have filed a suit against Sevier County, in order to “attack the way the government operates.”
Included in the group are the following: William England, Peggy Marshall, Catherine Gebhardt, Jeremy Schmid, William C. England Jr., Patricia England, Mark P. Lipton, Anita O. Lipton, Wesley Sellers, Donna Sellers, John B. Roberts and Billie Jo Roberts.
They are represented by attorney, Herb Moncier, and they have filed a law suit in Sevier County in order to “attack the way the government operates.”
According to this group of citizens, the mayor of Sevierville, Larry Waters, has been in office for 32 years and has arranged the government so that he and only he is in charge of all decisions and aspects of operations.
The plaintiffs believe that Waters has loaded up the commission with people of his choice, keeping control of the county by using the power to give out jobs.
Central to the case is that some individuals are holding more than one county position, while being paid with federal dollars. Moncier contends this violates the Hatch Act.
The reason for the law suit targeting Sevier County Mayor Larry Waters and seven purported employees of the Sevier County Sheriff's Office, who either serve on Sevier County Commission or are running for commission seats, is given in the first paragraph:
“This action is brought in the name of the State of Tennessee and in the name of the Sevier County District Attorney General on relationship by citizens, residents and taxpayers of Sevier County Tennessee to contest the lawfulness of Defendants holding office; to remove Defendants from office; to recover their benefits while holding office in violation of the law; for judicial review of Defendant Mark GOINS instructions to the Sevier County Election Commission that Defendants are qualified to be on the May 4, 2010 republican primary ballot; and for mandatory injunctive relief to remove Defendants from the May 4, 2010 republican primary ballot.”
The petition also seeks relief from Tennessee Coordinator of Elections, Mark Goins, who “… is made a party because it is his duty pursuant to T.C.A.§ 2-11-202(12) that provides:
Insure that all election commissions within the state shall prohibit any person from becoming qualified to have such person’s name placed on any ballot wherein such person is seeking to be nominated or elected to an office for which such person is ineligible or to more than one (1) state legislative office, as described in § 2-13-202, voted on by voters during any primary or general election.”
Also named as defendants are six other county commissioners who are allegedly employed by the county in some capacity, a county employee who is running for commission in the primary and one commissioner whose business activities with the Sevier County Public Building Authority are funded, in part, with federal funds.
Although the lawsuit was filed in Sevier County, many are seeking relief in court regarding similar situations — for instance, Brad Anders, a Knox County 6th District Commissioner who is also a Knoxville Police officer.

“To the fine folks of beautiful Sevier county, I would just like to say ‘thanks’ for the three decades you have allowed me to guide your home to the place it is now.
This position was created for me by a member of my wife, Teri's, family so that I could provide for her in the manner in which she was accustomed. So, for allowing our family to live at our present standard is greatly appreciated by us, and we would like to be able to maintain our present lifestyle for the next four years as well.
“Some of my supporters have asked me about the problems that I have been faced with in the last couple of years. They are referring to a minority of “wacko radical” Tea Party types that think that the minority should be heard in county government. They have filed lawsuits seeking my ouster from office, but I assure you this can never happen. My dear Daddy, who used to visit us from Cosby when I was little, always said “life is simpler when you plow around the stumps.”
“This is the advice I have always followed until this group of “stumps” got involved in our business. They are claiming to want transparency in the ways of our county government, so that is the direction I think we should go. I have been told by our county attorney, Jerry McCarter, that the transparency should be on a “need-to-know” basis, so there will be limitations.(end of story)

Now, I'm madder than hell about this but can't do anything about it! Although I've yelled and ranted, seems about all I can do, at this point is grab myself and hold on tightly and pray that I don't forget to let go before I've ruined myself!

I can't believe our god fearing mayor wants limits on transparancy. It figures. He has tried stacking the deck against everyone who questions his dictatership. He should read his bible and learn that the common citizens have every right to be heard. He should champion the common man! What he has been doing lately is so wrong and so antichristian. How dare him place limits on the constitutionallity of my USA. And what is with his fleecing of the county so he can keep his wife in the life that she's accustomed to? Is this why he has his family members on the county payroll? Painting his kids cars with taxpayer money and taxpayer bought paint?!? What else has he stolen from us to help his family? I hope someone calls the TBI. Better yet, someone should give Larry a gun and a handful of pills to chase down with some booze! Lying Bastard!!!!

Larry Waters cain't threaten our azzes any more than he has already, this has come to an end!

Our azzes are not his focus now, with this political windfall of the AU complaint being filed when it was, how great could the timing be for dear Larry - seems almost that he filed this (or had it filed) himself; so, we might now focus on what is right, as if Larry might take our advice!

If prayer is so important in the function of county government, as he and those coming out of the hollers and dells propose to make it - not that no prayer is allowed, the question being that it is the only prayer to be had - then, some might rightfully suggest that he and his cronies not be so hypocritical in their actions (if prayer is sought for guidance) and that they do their praying where/when and as a part of their conducting the business (at the time it is being conducted, not after the fact!)

THAT WOULD NOT BE AT COMMISSION MEETINGS!!

Rather, the prayer would be conducted, in private as they talk on their phones, meet in the stairwells of the courthouse in discussion, in meetings which have not complied by public notice that county business would be conducted. This is where the prayer belongs, consistent with where the business is transacted. This is a MUST if they are legitimate and truthful in their claims. But, this would not be consistent with the practices of Larry Waters as shown by his actions and proven by the facts shown to his followers and cohorts being shown facts by knowledge some have never seen or heard before, just recently.

Prayer (after decisions are made) is simply a SHOW! THIS is hypocritical, there can be no denial.

Let Lying Larry answer these propositions and prove he is not hypocritical, that he - as he has done by leading his followers in the Commission like sheep to the slaughter - is leading the good and tender-thinking 'sheep-like individuals'(though good intentioned) like sheep to the slaughter, a political tool well designed and carried out, by which none other than Larry, our Mayor, is to profit.
