Seneca Correction Officer Convicted of False Statements

Seneca County worker convicted

ROMULUS — A corrections officer was convicted Monday of two misdemeanors for lying on a police report.

In a split verdict, the three-man, three-woman jury in Romulus Town Court found David Jensen, 40, of Ovid, guilty of second-degree offering a false instrument for filing and making a punishable false instrument. They acquitted him of second-degree harassment, a violation.

All three charges stem from the same March 4, 2008, incident in which inmate Brandyn Backus of Seneca Falls was allegedly injured after he refused to get out of bed when three corrections officers asked him to. Jensen was convicted of lying about the incident in a report.

Jensen, hired by the department about 15 years ago, has been on administrative leave since last March, pending internal disciplinary action. When he is sentenced March 20, he could get up to a year in jail. Under state law, he could also be fired because of the misdemeanor convictions.

Jensen and his lawyer, Larry Andolina, who is the attorney for corrections officers union, couldn’t be reached for comment.

Stenberg informed the county Board of Supervisors public safety committee of the jury verdicts Tuesday night.

This morning, Stenberg said that the criminal case “took its course,” resulting in the conviction, adding that he wasn’t involved in the internal investigation, and two of his top officers were in charge of that before it was turned over to a special prosecutor.
