Damian Christopher Deleon, 26, was indicted on murder charges last week in the shooting death of Richard Gutierrez, 25, also of Mathis, according to the San Patricio County District Clerk's Office.

wow finally our family has recevied justice glad the killer is getting locked up and who cares if ur 100% DeLeon because they way u cry our family crys when richie is not here at least u can see ur bother behind bars and was able to hold him for a yr of freedom the dumb justice let him have now feel the pain when he is not there for the holidays the way we feel when richie is not here

Justice requires the maximization of the total or average welfare across all relevant individuals. Punishment is bad treatment of someone, and therefore can’t be good in itself. But punishment might be a necessary sacrifice that maximizes the overall good in the long term, in one or more of three ways:
1.Deterrence. The credible threat of punishment might lead people to make different choices; well-designed threats might lead people to make choices that maximize welfare.
2.Rehabilitation. Punishment might make bad people into better ones. All that ‘bad person’ can mean is ‘person who's likely to cause bad things (like suffering)’. So, utilitarianism could recommend punishment that changes someone such that they are less likely to cause bad things.
3.Security/Incapacitation. Perhaps there are people who are irredeemable causers of bad things. If so, imprisoning them might maximize welfare by limiting their opportunities to cause harm and therefore the benefit lies within protecting society.
So, the reason for punishment is the maximization of welfare, and punishment should be of whomever, and of whatever form and severity, are needed to meet that goal. It also suggests that punishment might turn out never to be right, depending on the facts about what actual consequences it has.
Maybe you can understand this considering that you cannot properly form a sentance or use proper punctuation. Did your brothers prison time deter, rehabilitate or just incapacitate him? Did he stop selling and doing drugs after he got released?
I am kind of tired of seeing his mother on the news when in the entire time I knew Richard, she was nowhere to be found. Whatever lady.

I can say that I was around Richard and his mom the last few weeks of his life. She had changed with him and was a good mom she didn't mistreat him in any way. She went and visited him as many times as he could, while he was in prison. He spoke of how she was there, in the end. That's all that matters. She wants justice. Well, what mother wouldn't? As far as knowledge, well he was a better person. Just because he was in prison, doesn't mean he was a bad person. He didn't kill anyone, that's for sure. Nothing, will bring our beloved Richard back, but knowing that his murderer will be behind bars, staring at those 4 walls, thinking about what he did over and over, for the next few years, reflecting on the life he took, stuck with those other murderers, who aren't so welcoming, brings us much satisfaction. In this life, you can't take another life, and not pay for it. Whether it be here on earth, or in the afterlife. It doesn't matter what excuse Damian has, he was sober enough to drive to his wife's house, aim a gun, shoot it in the air, shoot SOMEONE, and drive off. He knows what happened, and it wasn't self defense. It was murder. You may not think anyone will win, but knowing the things that go on in prison, makes it all the better. I don't care for Damian, one bit. I wish him all the hell in prison, prison can give. Then, we'll talk about justice, winning, and giving him the forgiveness, for taking such a wonderful person from our lives!

But it's the truth. He was one of those idiots, who everyone knew would end up locked up. He always thought he could fight or beat anyone but he just had a big mouth. He was obviously wrong. He was some felon who thought he was a superhero but really was a superzero. Didn't they find drugs on him or in him!? Damian was only indicted, he'll probably win the case claiming self defense especially when they hear richard Gutierrez was a crack head ex prisoner.
