The county board's Public Protection Committee ignored or disregarded the facts in this case. Deputy Swan's actions were justified, as testified to by the use-of-force expert / trainer, and all three of Swan's patrol sergeants. The chief deputy lied, and the sheriff also perjured himself while testifying against Deputy Swan. One week after Swan was fired, the sheriff admitted that Swan's actions were justifiable. Deputy Swan will be back to work, with full back pay, as soon as he can get a fair hearing in front of an arbitrator.

Yeah, too bad most of the reporters who "wrote" articles about this hearing, didn't even bother to show up there. Sounds like only one reporter was actually present throughout the hearing, and the others just got their (facts?) from who knows where... Obviously Kyle Weaver was not there.

What did the chief deputy and sheriff lie about?

The chief deputy pretended to forget on the witness stand that the department used to have an in-house Defense And Arrest Tactics instructor. The chief deputy "forgot" that the instructor was involuntarily decertified as an instructor after he ran for sheriff and lost. The sheriff lied and claimed that he did not see Lieutenant Steve Smith use excessive force when he struck a naked suspect several times with a baton, while the suspect was being held prone on the ground by two officers using armslocks, and the suspect was also being activly shocked by two Tasers.

Has the sheriff charged the lieutenant with excessive force yet? From what I hear, there probably won't even be an investigation into that fiasco. Sounds like it depends on who you are, rather than what you allegedly did that counts at that department.

It sounds like their too busy going after (retaliating against) the witnesses that testified honestly on Deputy Swan's behalf.

Sounds like a political hatchet-job to me. I wish Deputy Swan all the best, and hope he gets a fair hearing in front of an arbitrator. We need honest cops like him back on the street where he belongs. It's election year. Hopefully the citizens of Polk County show Tim Moore the door, and put an honest man into the office of Sheriff this time.

I have worked with Eric and know Eric. You will not find a more dedicated officer in the state then Eric.
Eric's training involved one of the worlds best known PR24 instructors Ed Nowicki. Stopping drunks in Polk Co might be considered excessive force if you stop the wrong person. Polk Co Politics have been this way for as long as most people can remember.

Why do some reporters only report one sided stories? Makes for better paper sales! Sounds like Polk County Sheriff and Balsam Lake Village Board have things in common- get ride of good officers that are threats to how they do their jobs.

I watched the video, looked a tad excessive to me, but I wouldn't want to be a cop either.

Nobody ever brings up the fact that Deputy Eric Swan wrecked three squad cars and was found to be at fault in four traffic accidents, in one of which he seriously injured a motorcyclist by running him off the road on a dangerous curve. Likewise, no one mentions that Swan "investigated" that motorcycle accident himself, rather than calling in another officer or agency. Swan may not have deserved being fired because of the takedown, but he damn sure shouldn't be on the streets as a police officer.

To "angry citizen taxpayer": Swan didn't run anybody off the road. The biker refused to pull over for an emergency vehicle, and then panicked and dumped his bike on some loose gravel, after Swan completed his legal pass. Swan completed the crash report after being directed to do so by the Lieutenant. When the admin presented their bogus evidence against Swan, their "expert" witness actually proved that things happened just like Swan reported them. What you been reading? The Sheriff's press releases? Go figure!

If you want to call dedicated a power-tripping control freak, then yeah he's dedicated. However, from a professional stand-point of being on the receiving end of him bringing patients to the hospital I worked at, what is he doing with an 18 year old girl that he picked up at 2am and didn't arrive until 6am? AND, not to mention, leaving the scene of an accident to "Profile" someone else not involved? I could go on and on, but these are just a few things I know about this so called "dedicated" cop that deserved what he got - being fired.
