A new and dangerous subplot is actively brewing behind the scenes at the Iowa Courts Online system. During a routine traffic stop, one Iowa man discovered that County District Attorney offices, dispatchers, and law enforcement are as practice and procedure skewing the Iowa Courts online system to intentionally and in error post case information where the State failed to prevail or a dismissal occurred in favor of a defendant or respondent.

County officials or functional operators of the Iowa Courts online system were apparently dissatisfied with a two year old case dismissal and took steps to post errant information to the Iowa Courts online system that elements of the case were still open, even after a simple misdemeanor for writing an email to State employee years earlier was dismissed by motion of the District Attorney in the interest of justice.

This development reflects the evolution of a shadow, manipulated usage of the Iowa Courts online system and National Crime Information Center (NCIC) records. The new procedure, now routinely used by police dispatchers effectively maligns and penalizes a citizen when the Iowa Courts have dismissed a case due to spurious charges or a finding of not guilty by a jury or judge.

The willful intent of these actions causes a negative outcome against a citizen when the State loses or has to surrender in a particular case. The manufactured, wrong information is posted for the State to“win” and wrongfully stain a litigant. County officials seem to misuse the system to exact suffering for what they could not achieve in court. These routine actions present a real & present danger to any citizen who may require a record check for employment, security clearances, or financial transactions. The State when notified of these matters unilaterally caused more damage than the original entries. Citizens need to be very vigilant against this new form of abuse of individual civil rights by agencies of State and local governments as they work in opposition to open records laws, violating Federal & Iowa Code in retaliation for demands for open records and transparency of government action

We both have cases listed online, for David, cases that are paid off, old cases that are duplicated, even listed three times, so it really looks bad for him. As for myself, Lillian, there are cases listed online against me, that I had no idea were there. I've had speeding tickets in the past, other than that, I have no idea what they are for or why they are there.
