Appellate court grants new trial in Platte County murder case

The Missouri Court of Appeals today ordered a new trial for a man convicted six years ago in the shooting death of another man over a set of customized wire wheels.

In 2002, a Platte County jury convicted Cornelle D. Williams of second-degree murder, first-degree assault and two counts of armed criminal action in the slaying of Rusty D. Clinton, 22, during a confrontation Feb. 24, 2001, in an apartment near Parkville.

Williams, who was 21 at the time, had maintained his defense attorney ignored his indigence and did not request a mental health evaluation for him. Williams had been diagnosed with 'schizophreniform type psychosis,' according to the ruling issued today. Read more

It is too bad that the victim doesn't matter. It is too bad that Kevin Johnson (the other eye witness) testified against him and our justice system is still giving this loser another trial. I guess the tax payers dollars wouldn't matter to someone who robs, steals, and murders for what they want in their life!

well mr. williams you not only murdered a family member of ours you have also destroyed us as a family. well its time for our family to ban together and fight to see that you rot in jail. Oh, how I hurt for your family. My son was murdered in Platte Cty. March 16, 2007. We drive the five hours each way every time the pond scum plays his "legal rights to a 'fair' trial" screech. Even with our two witnesses (his wife and his brother), three 911 calls just before, during and thru his entire murder as well as ovewhelming additional evidence, we haven't even got to trial. Now I hear from your pain, we get to survive the appeals process. Just not fair!
Seems to me there should be shortcuts to justice for the truely--beyond any doubt-- guilty.
Take heart. In Mo., just being crazy isn't any excuse for murder as long as he was aware of what he was doing at the time. In addition, your prison for the criminally insane mirrors horror movies and he gets to go back the regular prison if he is deemed stable.
Keep on posting so we know how to pray for you.
Keep on as a family. YOu need each other.

The MURDERER was granted a new trial. Now our whole family has to go through the nightmare again. We need a lot of prayers and positive thoughts to get through this again. Thank you!

Althought I have never lost a family member in such a way, I do feel for the family and their lose. I can only hope and pray you find the justice your family needs.

This news makes me sick that this murderer is getting another trial. Clinton family - my deepest thoughts and prayers. I knew Rusty in high school and he was a great friend.

I sat in the jury pool today, waiting to be chosen for this jury or released to go home. Obviously, I wasn't chosen. I didn't recognize the case until I came home and looked it up on the Internet. I remember it now. We were given hints of where the defense in this retrial is going. Today, the defense attorney said insanity would not be a defense even though that appears to be the excuse that got him a retrial. Now it sounds like they are going after self defense. We were asked by the defense attorney which of us owned a gun and if we believed in the right to protect ourselves. We were asked if we understood how a person might interpret a threat differently than another might. I am appalled at this tactic. I send my deepest condolences to the Clinton family, for your loss and the continued pain you must suffer. If those who were selected for that jury share my sense of justice, Mr. Gibson and Mr. Zahnd will quickly prevail and put Williams back in that hole where he belongs!

The re-trial for the beast that murdered Rusty ended late in the day yesterday.... Nightmare for all friends and family involved to say the least. The jury is still deliberating... I will post the outcome as soon as they've reached one. How hard it is to guess and hope that 12 perfect strangers want the same justice that you do for someone they never knew and someone I still haven't figured out how to live without. Rusty won't ever call me again, no hugs, no encouragement, no goofy nicknames, just a huge void that left me so numb and emotionless for 9 years. But I feel him around me every day. I miss him with every breath I take. Sometimes it is more than I can handle. But I believe that Rusty wants more for us than this. Rusty had a spirit way too big for the world we live in, I hope he is resting in peace. Spread your wings brother and fly.

We got a bit of justice today...the murderer was found guilty on all four charges...we are less than satisfied with his sentence, but he will be "officially" sentenced in May. Thank you to all of those out there praying for our family...we've been pretty close getting through this, and we are glad THIS part is over...AGAIN!
