DWI is serious however cell phones are far more dangerous, reason being far more violaters.

And the second part of the law - would require anyone charged with DWI to have an ignition interlock system. Anyone charged? Should it state anyone convicted or has the legislature in their eminent wisdom decided it's okay to punish individuals before they are convicted?

I think that this is a great move. Children should not be subjected to the ignorance of the adult who should be protecting them not throwing them in harms way.. However, will it be enforced, because a friend of mine had an accident not too long ago and she was visible drunk she did not hurt no one just wrapped her car around the tree and all she got was a ride home after she refused an ambulance. I think that the officers should not let any one slide with driving drunk period.... its the most irresponsible thing any officer can do....

We are all created equal...SOME are MORE equal than others...."Law enforcement".

No matter how you word it a civilian citizen will receive a stiffer penalty for Drunken driving. DWI and DUI should be felonies if committed by law enforcement, leading by example.

When I read this article I was so happy. This news is very fitting on a personal level for me this time of year, due to the fact that I had family members killed many years ago on New Years Eve. Some of my cousins had to grow up without their parents. My Grandmother still talks about it to this day. I think people that drive drunk are complete idiots and if they do it with kids in the car, they deserve to have their kids taken away from them. I applaud NYS on their constant efforts to discourage drunken driving.

Dear Realist- if they give you a breathalizer test and you BAC exceeds the legal limit-that convicts you right then and there.

Ok, I worked in Law Enforcement for 28 years. I didn't drive drunk, take drugs, rape women, steal, shoot people, or commit any other crimes. Does one bad nurse make them all bad?, does one bad doctor make them all bad? Does one bad cop make them all bad? I think not. I am so sick of reading the negative comments from the VERY FEW ignorant people on this board who constantly criticise every move made by our local police. If it weren't for the law and order YOUR local police provide for you, you might as well be living in Iran, Iraq or Pakistan where the religious gangs RULE. Get a life you idiots. Do you want people breaking into your homes and taking what they want? How about raping your women and children without being stopped? Would you like to have your throat cut, be burned and beheaded? If you have that many problems with authority you need to move to one of those countries that really doesn't have any. Please, do us all a favor and get out, stop whining, stop bit*ching, stop crying. I believe everybody is entitled to their own opinion however, your opinions are far to negative to be of any value. Please find something else to do with your boring spare time other than writing your negative diatribes in this or any other local forum. I truly believe the majority of us here don't want to hear your cry baby,immature comments anymore. I know for sure I don't. I protected your sorry azzezs for 28 years....

Dear Laurie W: First, one charged with DWI can refuse a breathalizer test. Secondly, the results of the test does not convict you right then and there. The results of such tests, which are offerred into evidence, are contested by defense attorneys on many occasions. By the way, where did you get your law degree?

.08 bac w/teen in the car and you could go away for 5yrs $5,000 fine and lose children even if they are not with you! smoke a joint 5 years! rape a kid and you can be out in months what is wrong with this picture people!! it is time for a change alright! time for a public vote on all new laws rather than let these corrupt judges make the rules!

most cops are corrupt! your mind is like a sponge you have to be careful what kind of puddle you soak it in! a real man takes care of there own without the help from the likes of you. i weigh 175# i don't think 3 beers should warrant going to prison if behind the wheel. get over yourself!

Fribnatz ; what do you mean when you say problems with authority ? Also police need to be held to a higher standard because we authorize them to have more power at their fingertips than an ordinary citizen.

cops are the biggest drinkers out there!! ever been to one of their partys?? and they drive. so why if someone has a couple of drinks they arenot drunk. you have to be wasted drunk to kill someone. now if you have one drink you go to jail but if you shoot someone lesser jail time. these laws are made so you the working person has to pay!!

I can't even could the number of times I've been at a bar, and a cop offered to buy me a drink and I have to tell him no thanks cause I'm driving.

I was in law enforcement for many years. I saw new york state troopers getting very drunk at a bar. they were in plain clothes but it was obvious especially when I went out and saw the unmarked car in the parking lot. It is time to make it a felony for law enforcement who are above .06 bac. I think cops should have breath and drug testers in their patrol car so every day they work they get tested. Cops are the worst offenders when it comes to alcohol and drugs. If they want the job they should have no problem being tested for alcohol and drugs every day they work.
