Ontario District Attorney Scandal Brewing?

CANANDAIGUA, NY--Michael A. Jones Jr., former attorney for the town’s Planning Board, has filed a civil suit against the town alleging that he was terminated and his payment withheld without “justifiable reason.”

According to the Canandaigua Daily Messenger, "Jones is seeking an undisclosed amount of money. He claims in the court papers the defendants acted 'in bad faith to further their own personal agendas ... having no justifiable reason to withhold payment duly earned and owing.'”

"Further claims are made that the defendants, aided by [Town Attorney Carol] Maue and Toby Reh, attorney for the town’s Zoning Board of Appeals, attempted 'to harass, intimidate and unduly influence' the Planning Board.

Reh, whose practice is in Jones’ hometown — Victor, is several times singled out in the suit, being referenced as Jones’'direct business competitor' and therefore having 'a direct and clearly imputed financial incentive in finding fault' with his actions. The suit further alleges that Reh used his 'connections and former powers as an Ontario County District Attorney to intimidate, impress and threaten potential witnesses against' Jones."

In September, the Messenger reported that Ontario County District Attorney R. Michael Tantillo received legal opinions prepared by Reh regarding Jones and the Town and began his own investigation into the Town's activities. In the article Tantillo accuses unnamed town officials of “potentially illegal conduct." However, as of yet, there are no articles reporting that he charged any officials with crimes in connection with the matter.

According to the Messenger, Jones' suit "names the town, its Planning Board and Town Board members Marion Cassie, David Dawson and Oksana Fuller as defendants." Currently, it does not appear that Maue, Reh or Tantillo are named defendants.
