"he entrusted someone to shred the files". What kind of professional office entrusts "somebody" to complete such an important task? There are plenty of companies that specialize in shredding on-site? There is no question that Mr. Litz was totally neglectful.
"he accepted responsibility" will only be known down the road. Will he provide credit monitoring for those whose records were exposed for who knows how long?
