Not surprisingly, those who support the "civil remedial fee" (read: illegal fines), continue to excuse an unconstitutional law on the basis of "it only affects the 'bad' people".

No, it does not. It will eventually affect all of us based upon the principle of "function creep". If we surrender our rights now to an unjust law, this will set a precidence for future uses not yet defined. Some legislature, somewhere, at some point in the future will use this law as an example to extract yet another measure of money out of our pockets without due process of law.

While many challenge the law as being unconstitutional based upon the 14th amendment (the law must be applied equally), very little attention has been paid to the fact there is no due process of law in the civil remedial fees.

Traffic court is a criminal court. Once convicted of a traffic offense the civil punishment is automatically imposed without a hearing or trial in a civil court. It would seem to me that the civil fees are beyond the purview and scope of a criminal court.

So if you find yourself agreeing with this law because you don't see yourself as a 'bad' person... consider the possibility that you're government basically views your life as their cash cow, or personal piggy bank. If we allow this law to remain, we will all pay additional fines and fees in the future without any recourse.

If this makes you as mad as it does me then I know you will be glad to sign this petition to stop the ridiculous fees the state is making ONLY Virginia drivers pay!! If you would like the list of what the fines are now as of July 1, 2007 then click this link.
