<quoted text>What's your point. Are you trying to say you weren't drinking or you weren't in public?
No kidding? Sounds like any decent judge would have thrown those charges to the curb. How did the officer have probable cause?

<quoted text>It's not switching back and forth. You are talking about two separate issues. Your example indicates a clear case of trespass. The law states that it is illegal to openly consume alcoholic beverages in the view of the public, even if one is on one's own land. Once the officer observed the violation he had the legal right to come on the land to make the arrest, therefore he committed no trespass.

I have read all the posts on this topic. To say that Leslie County KY is "dry" is a total JOKE. It may be legally "dry". I have been in a lot of counties in the USA. I have never seen people drink more alcohol anywhere EVER. They buy beer by the case and drink it in one sitting. The same huge quantities are consumed of hard liquor. Never mind about pills... Good grief! It makes one wonder if Law Enforcement in Leslie county KY doesn't get their sacks of $ from the illicit drug trades & booze. Who would have to go to a bootlegger? This is 2010, sir, not 1810. Most people have a car or truck and buy all the alcohol they want and bring it right back to Leslie County and drink as much as they can before passing out. What you should be worried about as you appear to be some type of officer of the law is how to keep Leslie county free of illegal gotten a highly addictive drugs like oxycontin& crytal meth. You should also lobbying to make Leslie County "wet" so that people don't drink and drive on their return trip from from the liquor store. A drug addict will do anything to get their drugs. Take responsibility for the victims of crime perpetuated by drug addicts!!! The above are simply my opinions & as a U.S. citizen, I am allowed to state them. I would recommend, sir, that you reassess your life creeds and get treated for being so anal.

<quoted text>There are a lot of things that should be or shouldn't be the law in my opinion too. This is how the statute reads however:
222.202 Offenses of alcohol intoxication or drinking alcoholic beverages in a public place.
(1) A person is guilty of alcohol intoxication when he appears in a public place manifestly under the influence of alcohol to the degree that he may endanger himself or other persons or property, or unreasonably annoy persons in his vicinity.
(2) A person is guilty of drinking alcoholic beverages in a public place when he drinks an alcoholic beverage in a public place, or in or upon any passenger coach, or other vehicle commonly used for the transportation of passengers, or in or about any depot, platform, or waiting room.
The definition for "public place" as used in this statute is as follows:
"Public place" means a place to which the public or a substantial group of persons has access and includes but is not limited to highways, transportation facilities, schools, places of amusements, parks, places of business, playgrounds, and hallways, lobbies, and other portions of apartment houses and hotels not constituting rooms or apartments designed for actual residence. An act is deemed to occur in a public place if it produces its offensive or proscribed consequences in a public place.
If you put the beverage in a container so that it can not be identified as alcoholic then you would not be in violation of the law, unless of course you were manifestly under the influence
A persons property is NOT a public place. If you were outside Leslie County in law enforcement, You would have been fired long, long ago. Dept of Justice needs to come to Leslie County and clean house on all fronts and they would probably put you in federal prison for your UNCONSTITUIONAL actions.

My grandfather used to make moonshine and sell it for a living (he was disabled). He is deceased now. I have never even as much as tasted the stuff ( moonshine ) before. I have no desire to try it.

Does the title of this thread actually mean that moonshine is "still" found E. Ky or that a still was found in E. Ky? Just a little play on words there. I live 8 miles from the Collierville, Tn and 75 miles from Corinth, Ms. You can't buy alcohol on Sundays in either town but drive on to the next town and you can. Yeah,....I know and this is 2011! Like Buni Faye above, I read and enjoyed every last post. Oh, and "shine" is also made in Marshall County, Ms., probably a lot of places. Thankx Hazard for this thread, wish they were all this interesting and I hope the feller that got arrested gets off clean!(#129,.. I'm with ya.)

Up yours you conservative winch.
A five year sentence for a old timer like him is like life in prison.

I love you're response, I know this is old, I've been reading through it all. FACT, FACT, FACT,....Love it. Thanks for the facts on everything AND if they "throw 'em in jail and throw away the key" people took a good look in the mirror, in this country today it's very difficult for "law abiding" citizens to abide ALL the laws, guess they have never j-walked, went 60 in a 55, ect, ect, ect, take those hypocrites and throw away the key, I really can't stand people like that. Again, thanks for laying the facts out there!

Why? You don't even know the man, and he's only 66 years old. Why would they put him in prison for the rest of his life, which could very well be 20+ years, over around $300 in unpaid liquor taxes?
Federal laws concerning moonshine:
Maximum of 5 years in jail, and/or max $10000 fine.
Now, let's look at a law that 45ACP breaks all the time! He says he drinks, yet he lives in a dry territory? Hmmm, isn't it illegal to bring alcohol into a dry territory? I think so!
242.260 Transportation and delivery in dry territory prohibited -- Exception.
It shall be unlawful for any person or public or private carrier to bring into, transfer to another, deliver or distribute in any local option territory any alcoholic beverage, regardless of the name by which it may be called. Each package of such beverage so brought, transferred or delivered in such territory shall constitute a separate offense. Provided, however, that nothing herein shall be construed to prevent any distiller or manufacturer or any authorized agent of a distiller, manufacturer or wholesale dealer from transporting or causing to be transported by a licensed carrier any alcoholic beverage to their distilleries, breweries, wineries or warehouses where the sale of such beverage may be lawful, either in or out of the state.
I wonder if he ever shares a beer with a buddy?
242.230 Traffic in alcoholic beverages in dry territory prohibited -- Unlawful possession prohibited.
(1) No person in dry territory shall sell, barter, loan, give, procure for or furnish another, or keep or transport for sale, barter or loan, directly or indirectly, any alcoholic beverage.
Sounds like 45ACP is a common criminal! Should he ever see the light of day again? Of course! These laws are stupid and should be repealed!

I have two questions for you. What if KY state troopers are buying moonshine from my neighbor, who happens to be making a pretty good profit from it, not only do the state troopers by it, but some attorneys, members of the local police dept also buy it from him. can't report to any local offices,so who can be contracted.
Second are state troopers, and other law enforcers allowed to use a cellphone while driving their cop car?
