Felons ordered to submit DNA

Are persons who were arrested and charged with a felony but convicted of a lesser misdemeanor charge in the end, required to submit their DNA? Or the database only CONVICTED felons? I know a bad guy who got away with bad stuff and always got the felony charges reduced to misdemeanors.. just wondering if HIS DNA got lost too
