Hate to say it but I highly doubt the charge will stick in court.

The reason being: she ***stalked him first***

If you go uninvited and post rambling nonsense on somebody's facebook page, then you instigate the situation in first place. The defense will argue he was simply *reacting* to her comments.

Sure, he over-reacted and shot his mouth off but so what. This is NOT a case of cyber-stalking.

I'm just saying -- whoever filed said charge filed the wrong charge. The correct charge is making criminal threats.

Due to this legal bungle, this could scuttle the prosecution's case.

And this could lead to civil litigation against the girl since she "attacked" him first.

Unless his defense council is that apathetic or incompetent, they will have a field day with this in court.

I don't know who advised this woman to press stalking charges but it won't stick.

She should have stuck with a making criminal threats charge.

And for the love of God, he's in a wheelchair and obviously off in the head. This man isn't a criminal, he needs serious medical psychiatric help.

He belongs in a group home, not in jail.

This is just another waste of tax payer money.

Declare him mentally unfit to stand trial, which he is unfit, and throw him the group home.

There he can get the help he needs.

I really think this guy has a solid defense due to a botch in charges.

Also, if this man isn't religious or isn't a Christian then her sending him a bible verse could be seen as setting him off.

If the charge does stick, and I would be shocked if it did, he'll probably get probation and anger management classes.

Even if the quote was vulgar, you can't insert your personal vendetta into the charge.

And I think it's blatantly obvious the woman's action and not minding her own business set this crazy nut off.

Don't be surprised if you read in the paper about him getting let go.

And my condolences to the family of the individual killed.

Another thing really, I'm not really that religious. I do attend mass occasionally though so religious things don't offend me but I do know atheist people who get very offended when people try to convert them.

But if this guy doesn't believe in God or if he's Muslim, Jewish, whatever, then he has a right to be left alone by people of other faiths.

Again, this crazy guy just reacted. Sure, he was vulgar, but again, the charge is wrong.

This is making criminal threats.

Either way, do you really want to pay for him at the ADC? You know how much money it costs to put somebody up in that place?

Why not send him to Whitfield and let the state pick up the tab instead of the taxpayers here in Jackson County?

And yeah, I know we pay state taxes too but still, the state has a lot more cash than we do.

For the record I know this guy and Muslim, Jewish, or Atheist is not the problem.

Wrong charge or not it was wrong and something needs to be done about it. I posted something to him too because it was a good friend of mine that died in that accident that he made remarks about. That was not the only person that posted something on his page about it either. Plus he put it on facebook for attention, he has the attention he asked for!!!

If you allow your Facebook space to be public, rather than private... as he did, you are implying that you don't mind public comments.Same with her, she could have made the page private.But for anyone to threaten a woman and her kids with sexual assault implies this person is troubled to say the least.

This man or should I say boy should serve the most time they can give him for the charges pressed on him. The woman was only giving him a bible verse to stand up for the crude things he said about a man who was killed in a car wreck a few weeks back. Calling the young man nasty names and laughing and saying he deserved it. This was his second time to do this also. He did it in early years about a young girl who was also killed in a car wreck saying that she deserved it and it was very funny that she was killed. He only does things like that because of the fact that he can get away with it. He thinks due to the fact he is in a wheel chair that people will give him pitty. He is only paralyzed because he idiotically dove head first into water that was a foot deep onto rocks after a flip flop fell overboard when he was in high scool. He had the chance to walk a few years later but he gave up going to therapy and walking because he would not get the check that he recieves from the state for being handicap. He can stand and still could walk but will not do it. Also people would not let him get ahead and away with things like he gets from being in a wheelchair. He is a waste of oxygen and that is where our wasted tax dollars are going! He should be behind bars!
He went to a great extent to send this woman e-mails about her two young daughters, saying he was going to eat them for dinner and that he was going to perform sexually acts on them and actually sent pictures of him doing so to their picture. It was sickening and he continued to do it only for that fact that he thought he was going to get away with it like everything else he does. She was the only one that had enough guts and overlooked his wheelchair to come forward to turn him in. He said many things to other people for asking him to quit posting the things he was posting about the young and other people that asked him to stop. He also threatened people with firearms, posted pictures of him with firearms held to his head acting out what he was going to do to them. The things he said and did disturbed me and really enraged me. He is mentally stable just does and says whatever he wants no matter who it hurts because he can and noone will do anything about it simply for the fact that people will not stand up to him because they pitty him. He deserves everything that comes to him and more!
