Apparently, in Gloucester it is if you are under 18. There was an intoxicated passenger in the back seat of the crash that killed our son (he was a seat-belted front seat passenger). She got a year with a restricted license, a year on probation, 40 hours community service, 10 ASAP meetings, and a fine.
The driver, however, got a $70 fine and a slap on the wrist.
It is kind of hard to see any justice in that particular situation.
The fine hardly seems fair in the case you stated.:( And until the punishment is swift and harsh, the killings will be continue.:(
