There are 129 comments on the Hampton Roads Daily Press story from Mar 25, 2009, titled Petition battle to return to court. In it, Hampton Roads Daily Press reports that:

Circuit Court Judge Westbrook J. Parker broke months of silence Tuesday by allowing 40 Gloucester County petitioners back into court to argue that he wrongly fined them $80,000. Parker, in a letter filed in Gloucester County Circuit Court, stood by his December decision to make petitioners pay $2,000 each toward attorney fees accrued by the four ...

Parker did not address the First Amendment violation? Why not? That is appalling!! Are judges not accountable to anyone?

Regardless of what happens in court, a breath of fresh air will waft through Gloucester come November when the removal process will begin; petitions or no petitions.

Who is this Judge? Does he have the right to violate our First Amendment Rights? Quess he thinks he does since he didn't address it.

I hope Parker raises the sanctions to $3 or $4 K each since more money is going to be spent on this!!! After their day in court, will the petioners admiit they where wrong if the outcome is the same....I doubt it!! Do they really want to undergo cross-examination?? I can't wait to hear those answers!! While we are at it..lets get the SGJ members on the stand as well. Did any of them sign the petitions? If so, can they be called to testify? This could get very interesting!!

Back peddling at his best and still trying to defend his original position!

None of the 40 were ordered to be in court. Some NEVER received the motions/briefs/crap from the attorneys of the FOUR. Others received it 3 or 4 days before the hearing. Some of us tried to get it postponed in order to prepare and that was denied. Randall is from Suffolk (as is Parker) and was appointed by this judge to handle this case. Many of us were in court but dare not have opened our mouths because of the threatening attitude of this judge! There was absolutely NO WAY he would have listened if I had wanted to tell my side of the story! We were strictly observers - and his attitude toward us was hubris, arrogant and he attempted to treat us as STUPID criminals.

Judge Parker tried to intimidate us into just paying up and then going away defeated. Didn't work! And it will not work until and unless the Supreme Court of the U.S. tells me I have to pay.

Well said and I agree 100% again Pete, keep up the course for our First. Parker has backed himself with troy into a corner pocket and "would never admit he is wrong".....it would hurt his
character, regardless, that has already happened.

It is my hope and wishes, Mr. Emmert and the Thomas Jefferson Inst. pound the First into troy's brain and parker's future as a judge for this appauling dastard disregard forour Rights.

Anyone want to put a little money on the outcome. Judge Parker has seen his next re-appointment to the bench disappear because of his last decision. He doesn't give a hoot about justice or the 1st admendment. He just wants to save his judgeship. He doesn't want to have to make a living as a lowly attorney again. Who the heck would hire him?

# 3 You obviously are ignorant in OUR Constitutional Laws or History. If you were a bright person, you would NOT hustle so fast with your language regardless of your tooting your horn for TA etal. Regardless, this is a fight for our RIGHTS, that have been tested, how stupid are you? What part of that is "blank" in your mind?
Until it happens to you perhaps? YEP.

You folks in Suffolk are stuck with Parker full time as head of the court there. A perfect example of incompetent being put on the bench. You should get your fellow citizens and flood your General Assembly representatives with complaints and urge them not to re-appoint Parker in 2010. This man is dangerous to our rights and must be removed from any position that affords him the ability to do his harm.

Surely Suffolk has qualified people that could sit on the bench with honor and integrity something that Parker doesn't know the meaning of.

Right there with you! Ask M Boon about her letter to Hicks as she filled her SGJ seat. Ask about the circulating e-mails that the petitioners sent in their plans to demise the BOS4. This isn't about the First Amendment as so many claim but instead a political plan gone wrong against good outstanding members of the community. The petty 40 have had their day in court and continue being dregs on our justice system. Think twice about filing a lawsuit versus a petition next time! Not all the petitioners were fined so folks, this is not about the FIRST it is about mean-spirited folks playing with good ole boy politics and crying because they did not get their way. Boo-whoo!

Wrong, wrong and wrong.

You assume that the 40 all knew each other and were conspiring since the election. That is so wrong!! Many of us had never met each other ever, didn't know Whitley, Stuck, Hicks, Shaw or any of the SGJ members. That is another reason that Parker is wrong in his ruling. He can't possibly know the motivation of each individual petitioner.

Having followed this almost from the beginning; I would really like to be there for this hearing. I didn't see any date mentioned in the article. Does anyone know approx. when it will be? Is this to be held in open court (I hope), or will it be a closed hearing. Somebody save me a seat.

"Therefore, I will allow the petitioners another opportunity to present evidence on the sole issue of who is responsible for the attorneys fees."- Judge Parker said...well that is damn decent of him, since he didn't allow the petitioners to present anything in the first place. I just hope the judge gets sanctioned, or fined, or whatever can be done. Simply not reappointing him is not sufficient.

Yeah! That is right! Remember there were 3500+ signatures. NOT ALL PETITIONERS were fined, only the ones who filed in the form of a LAWSUIT which had their names notarized! That "Sunshine" is the factual difference!

They are backed into a corner, Parker and Troy and aside from losing face, this is the best Parker can come up with to "cover" his buttuty.

I am thinking of going to the hearing just to hear that Letter from The Thomas Jefferson Inst
is writing, read to Parker and Troy. & the looks on their grey pale faces when it is read.

I will have legal counsel there just in case, IF I attentd. These antagonists are not seeing clearly, and the mental state they are in they might start highjacking people in the court room.:D

Yes indeed, they are some devils at work.
