DODGE CITY — The Dodge City-based company JAG II was fined $22,000 this fall for practicing architecture without a license, according to the company's settlement agreement with the Kansas Board of Technical Professions.
The board had received a letter in February 2001 concerning the company's design/build practices concerning commercial buildings, the board's executive director, Jean Boline, told the Globe on Wednesday. After a lengthy investigation and related legal proceedings, which finally wrapped up this September, the board and the company reached a settlement agreement which contained the following stipulations: • The company is not licensed to practice architecture in Kansas, nor does it hold a certificate of authorization to practice architecture in the state. • The board contended that the company practiced architecture by preparing preliminary drawings for the Mariah Hills Golf Course clubhouse and the Dodge City Downs concession/restroom project. In addition, the board contended that the company practiced architecture by developing a bid package for design-build proposals for a practice school gym in Greensburg. Additionally, the board said that JAG II's ads in the Feist Yellow Pages in 2000 and 2001 constituted an offer to practice architecture or engineering. The company denied that it had violated any provisions of state law, according to the agreement. JAG II President Jim Coffin declined to comment on the settlement agreement Wednesday. City clerk Nannette Pogue said the clubhouse drawings were prepared at least 10 years ago, and it was unclear whether city officials had thought at the time that JAG II needed an architectural license to perform that task. Dodge City Downs proprietor Manuel Manriquez told the Globe that he was unaware that JAG II was not licensed to practice architecture in Kansas at the time of the restroom/concession project, which was nearly eight years ago. He declined to comment beyond that. The Greensburg school district office was closed Wednesday for winter break. Settlement terms Under the terms of the settlement with the Board of Technical Professions, JAG II agreed to work with appropriate licensed professionals on any future projects. Those professionals would be responsible for developing all designs and construction documents for constructing or renovating buildings, except as exempt under state law. The agreement does not prevent the company from developing information for the project owner's use, as long as that information does not include architectural services as defined under state law, according to the newsletter. The company may also prepare and present undimensioned floor plans and elevations as part of a pre-selection sales presentation, according to the settlement agreement. In addition, the company may use the phrases "design-build" or "design-builder" in promotional materials as long as an licensed architect or engineer is on hand to provide those services. The agreement said that the company denied any violations of the law governing technical professions or other regulations and had agreed to the settlement to avoid litigation. The board's executive director, Jean Boline, told the Globe on Wednesday that JAG II paid the $22,000 — which covered investigative costs as well as the fine — in September when it signed the settlement agreement. The case is now closed. Boline said she could not disclose who had sent the original letter of inquiry because that information was part of the board's investigation, and investigative materials are not normally released to the public. |
