As county attorney, it is my constitutional and statutory duty to provide legal advice to all county boards and officials, including the newly formed Ethics Commission.

Is Leeds problem with Jose Rodriguez or the county attorney's office advising the ethics board. The fear was the ethics board would be used for a political agenda. I guess that fear has been realized from the first meeting. Leeeds wants to punish Comm Perez and Jose Rodriguez. Leeds of course fails to mention county employees who run for office from other county departments such as District Clerk (Delia Briones); District Attorney (Jim Callan, Dolores Reyes and Beto Acosta); Tax Assesor (Norma Favela). No ethics board can prohibit these employees from running for county elected positions on their own time and own their own dime.

I dont see many 'gaps' in the enbling law and portions should be repealed.

Chevron, 467 U.S. at 843-844 (citing Morton v. Ruiz, 415 U.S. 199, 231, 94 S. Ct. 1055, 39 L. Ed. 2d 270 (1974)). If an explicit gap exists, then there is "an express delegation of authority to the agency to elucidate a specific provision of the statute by regulation." Id. at 844. Such legislative regulations "are given controlling weight unless they are arbitrary, capricious, or manifestly contrary to the statute."

An express delegation must be clear from the terms of the statute. See, e.g., Batterton v. Francis, 432 U.S. 416, 53 L. Ed. 2d 448, 97 S. Ct. 2399 (1976)(where the Secretary of Health, Education and Welfare was directed by statute to define the term "unemployment" in a provision of the Social Security Act).

As a concern citizen I am curious as to what happened to the empunction matter? Is this not a matter of public concern? Shouldn't the ethics committee stand free from the County Attorney to be able to make decisions' on their own? Although you state the Constitution and the law provide the Texas Attorney General has stated , that the El Paso County attorney must act as the attorney for all county officials,boards, and commisions besides county hospital, and civil service commission, it is apparent that it would influnce a newly created ethics committee? The whole purpose ot the ethic committee was created to bring every aspect of corruption, cover-ups and other misdeed's by elected officials out into the open to be judged by member's of their own peers. If further action is to be taken of anyone caught committing a crime against the community they are doing their job. It does not seem like a smear campaign against the County Attorneys Office, a county commissioer and other supposedly respected members of the judiciary! It sounds and looks like Mr. Leeds has started the work he was appointed to do!
