I was a passenger in a roll over vehicle accident that occurred May 13, 2006 on Old Gordon Road I was taken to the hospitals ER Trauma center. I sustained many injuries's that I will have to deal with the rest of my life. My husband was the driver of the vehicle, both he and I had blood drawn while in the ER where my fingers were being reattached, a RN came in and told my husband and I that my husbands alcohol level was three times over the legal limit. I would like to know why the responding Bibb County Officer did not follow through and my husband was not sited for DUI. I have hospital lab reports showing his alcohol level and in the accident report he is listed as the driver. So I am asking that someone tell me why he did not receive a DUI. This would have been and should have been his fourth DUI. I'm not going away until I have answers.

Ms. Tague, I am DDG's husband. I am in law enforcement and have been for years. First the RN that told you your husbands BAC was three times the legal limit, can't be true. In ALL cases the hospital draws the blood and WE send it to the G.B.I. Crime lab in Atlanta. The hospital only knows if alcohol is in the system, they don't know how much. The reason they check the blood in a serious accident is to know what might be ingested so they know what medication to give to aviod a counter reaction.
Secondly, you should have known your husband was intoxicated. You, of all people should have known. You are married to him and I suppose you live in the same house and talk to him nearly every day, right? His behavior, his speech, the way he walked, the way he smelled,( most alcohol has an odor) finally the way he drove should have been a clue. If you did not recognize any of those factors then you were more than likely also intoxicated.
If you want to find out why charges were not brought against your husband, call the D.A.'s office. Explain to them what happened but be sure to tell them everything or you will be just wasting their time and your's. If you were also drinking tell them. It will not matter if you were because you were not driving, but it will let them know the facts. Question, were either of you thrown from the vehicle? If so then that maybe the reason he wasn't charged. It's difficult to determine who was driving when someone is ejected.

All true, but hospitals do have the ability to tell the amount of alcohol in the system. But for legal reason I understand why it is sent to the crime lab.

After checking myself DeputyDogsGirl...You are not correct. The hospital does in fact have the means to check the alcohol levels in the system when drawing blood. And did so. Second no one was ejected from the vehicle. And my husband admitted to being the driver to the officer as will as the insurance company. And let me also clue you in to the fact that the responding officer stated to me on the phone that he did request a BAL be taken at the time of the accident but failed to follow up with the crime lab on the results due to the fact that the crime lab failed to report the results back to him in a timely manner. And when the results where finally received the responding office now had the proof that the driver was intoxicated at the time of the accident I can only guess that he felt it was now to late to do anything about it and directly told me (the drivers wife and passenger) that he was not going to site my husband due to the fact that it sounded like I was just trying to cause problems for my ex. And to answer you about the fact was I drinking. Yes I was, but I was not the driver and was being responsible enough (so I thought) at the time to have someone pick me up who was not drinking. It is hard to smell or tell if someone has been drinking if you yourself have been. And to point out a fact to you. If you live in the same house and see each other daily this only means you should be able to trust that person when they say they have not been drinking. And if they would have looked at all they would have seen my husband had many prior DUIS. Even one while serving his Country in Iraq..So now please answer me this. Finding out that the results where sent to the crime lab and did come back positive and my husband never denied but admitted being the driver and sever injury's did occurred. Why was he not sited? This will happen again and when it does I can only pray that the responding officer feels something for what may happen to other victims.
