Our City/County Leaders will stop digging the Taxpayers into the hole, ONLY when they have their shovels taken away from them.

THE LAW, Tenn. Code Ann.§ 13-7-208

A grandfather clause or provision is defined as “an exception to a restriction that allows all those already doing something to continue doing it, even if they would be stopped by the new restriction.” Black’s Law Dictionary 629 (5th ed. 1979). A grandfather exception must be construed strictly against the party who seeks to come within the exception. Smith County Planning Commission v. Hiwassee Village Mobile Home Park, 304 S.W.3d at 310 (citing Teague v. Campbell County, 920 S.W.2d 219, 221 (Tenn. Ct. App. 1995)).

Tennessee’s grandfather provision for zoning matters is found at Tenn. Code Ann.§ 13-7-208, which reads in relevant part, In the event that a zoning change occurs in any land area where such land area was not previously covered by any zoning restrictions of any governmental agency of this state or its political subdivisions, or where such land area is covered by zoning restrictions of a governmental agency of this state or its political subdivisions, and such zoning restrictions differ from zoning restrictions imposed after the zoning change, then any industrial, commercial, or business establishment in operation, permitted to operate under zoning regulations or exceptions thereto prior to the zoning change shall be allowed to continue in operation and be permitted; provided, that no change in the use of the land is undertaken by such industry or business.

I guess this means that instead of putting it in the present landfill (east side) they will start putting it in the Garbage landfill (west side). Isn't that classified as a Class 1 Landfill. Thanks Tim Wirgua for your help!!(not)

Waste Management no longer deals with Aluminum Dross. If they would have accepted it into their landfill the E.W.S. site would have never been built. The Volatility of the dross makes it nearly impossible to mix with any other type of waste.

A big Part of the problem we are facing is Dross is classifed as industrial waste. It needs to be reclassified as Toxic waste.
Our biggest hope still lays with Jackson Law violations.There were no public hearing held before the permit was upgraded to permit the change from tires to Dross.It's not over yet as more and more people become aware and join the fight as chances of stopping this maddness become better.Everyone needs to contact the Gov Haslems office.Tell him to get off his a** and stop trying to ignore this problem. He has rich friends that have contributed big $$$ in EWS. He has the power to stop this if he will get off his A** and use it !!!!!!!!!! The one and only Duh HuH

Do you really think Haslam is going to do that? He's trying right now to stack TN's Judicial System with hand-picked Judges instead of letting the People vote for them. I doubt that he's going to do anything for the People of Benton County against the Rich Dump Owners. Futhermore, if they get the Constitution changed so they can hand-pick the Judges, no Little Person will ever win against the Rich Guys on anything. Folks, we're in big trouble in this State & most people don't even realize it.

Yes have and do email the Gov and TDEC and get absolutely nothing but an update from a TDEC person every once in a while. And where as I well thats none of your business.
