Judge Orders Defendant's Mouth Taped Shut

An eastern Idaho judge who lost patience with the disruptive behavior of a defendant ordered court officials to tape the man's mouth shut with duct tape during a court hearing.

This is taking a "GAG ORDER" way too far. In the end the Bad Guy will walk and only the judges ego will be served.

This won't affect the sentencing, but it is a stupid thing to do. There are plenty of safe ways to gag a prisoner, and they can be used to silence a disorderly defendant. But duct tape is not a safe way of doing this. There are plenty of other options.

Of course, if he is found to be mentally incompetent, then he can't help in his defense anyway and can be left outside the courtroom.

Why not just dismiss him for disorderly conduct and continue without him?
Duct tape on a mentally unstable person is not logical and could add to his unstability. Could he not order him a tranquilizer and adjourn for a short break?

Oh come on ! You opt for tranquilizing him against his wishes but duct tape is a no no ? How many times have you wanted to tape someone's mouth shut ? I know I have, many many times. The guy was not respecting the court and acting out and mouthing off.

Tranking him is certainly a better option than the pain and cell damage caused by ripping off duct tape, especially over a mucus membrane like the lips. And if the guy has any facial hair or stubble, it' like getting a brazilian wax on your face. Not pleasant at all.

Even the S&
M community stopped using duct tape as a restraint, unless there is a layer of fabric between the tape and the flesh.

They would be within their right to do so if you get out of line in court. My objection is not to the taping itself, but the use of duct tape. There re safer materials, as well as alternative means of gagging someone who is acting out.

Yes, gagging people in a courtroom is a very effective way to silence one. Let's gag them all. There's absolutely nothing wrong with gagging the people in a courtroom. It's done every day. Judges around the country, from every state and town wake up early run to the court house and get ready for the gagging. Let’s use that humane tape though none of that gray stuff. Get the fvk out of here!!

There are legal means to control an out of control defendant. The defendant doesn't make the decisions in court, the judge does. He or she has a broad authority to make sure that proper decorum is maintained.

I suppose it doesn't occur toyou that an obstreperous defendant is actually damaging his own case by showing how little control over his actions he has.

There is absolutely no right to disrupt a court proceeding.
