WALGREENS WRONGFUL TERMINATION: Was I fired because I'm HIV+ ?

I had to start taking medication in may of 2009 and company policy is: employees have to fill their RX at Walgreens. I take HIV medication and was having alot of problems adjusting to the meds, had to call in sick a few times- got written up, was asked how I got infected, schedule was changed without warning, told to take vacation days when they over scheduled other techs, and finally got written up jan 2010 and fired because I didn't get manager approval to cover a shift, when I was informed that it was my responsibility to cover my scheduled shifts when I started school... I did what the pharmacy manager told me to do. The day I was fired he didn't even have the balls to be present!!! He had his flunkie store managers do the dirty work. What really pisses me off is that I thought I was working with professional medical staff and what I really was working with was a bunch of ignorant, racist, judgmental idiots! I'm not ashamed to have HIV - it just pisses me off when negative reactions impact my life!

I'm not sure where you get the idea that as an employee of Walgreens you have to get your RXs filled at Walgreens. I have absolutely no idea where you get that from. My insurance is through Blue Cross Blue Shield (Walgreens Group card) and several times I've filled my prescriptions at other places other than Walgreens -- once very recently due to where I was located at the time.

well here in oregon we have to fill our RX's at Walgreens, medical this year is BC/BS, Hnet, and a communitybased program, and delta dental.

I do feel for you, and I'm sorry you lost your job. There may have been some discrimination involved, so you probably do want to file an EEOC complaint at the very least. On the other hand, it depends on how well their side is documented.

Did they do a writeup after multiple sick calls, or was it just after a few times (assuming you told them of your condition, showed a doctor's note, etc.) I really can't see someone getting written up after a few times unless something was really wrong or the manager was an a**.

Schedule being changed...I've seen managers change the schedule if people call in sick one time too many, since it goes to dependablity, although every manager is different. Then again, it could be due to hours being cut which is happening everywhere. Hard to tell there.

Overscheduling...ok, the manager was wrong on that one...or just a bad scheduler. Known quite a few that can't reconcile to budget.

As far as getting fired for not covering a shift...I'd have to side with them on that one, although it seems a little extreme for a first offense. You're responsible for covering your shifts AND letting the manager know what's going on if you switch with someone. Basically, you can be fired for what they call 'no call/no show' if you don't show up when scheduled and have no legitimate reason for doing so. Seen that happen too many times at the front end, although it's usually the second time they do it that they get fired.

I hope you understand that I'm not being negative, but just thinking out loud. That being said, if they did fire you for having HIV then you should sue the hell out of them. What's one more lawsuit, anyway:-)

You are lying! If you weren't lying you would get a lawyer. You do not have to fill you prescription at Walgreens, another lie.

He's right about having to fill RX's at Walgreens. The confidentiality at my store was ridiculous and I've seen the manager look up employees prescriptions. Thats why when I needed an antianxiety med I went to a competing phramacy, wanting it to be confidential. I was told by (CVS) pharmacist after he made a call to the Walgreens Pharmacy that my prescriptions are only covered at Walgreens, and I would have to pay full price at CVS. Not only that, one time I was prescribed codeine cough syrup and was told by the Manager NOT the pharmacist, not to take my medication at work. Unbelievable lack of confidentiality.

UPDATE!

I wrote this article to educate people about what life is like being HIV+. I didn't write this to create drama. I share my life by writing and speaking publically. I talk about real life stuff, stigma, HIV, recovery and self worth. I hope my story helps someone else deal with their life on life's terms. Yes, I was wrongfully terminated and yes I filed a complaint. And I choose to stop the madness at Walgreens before my coworkers jobs would be at risk if they testified on my behalf....and yes they were willing. However, I am not willing to see more families struggling because the breadwinner is unemployed. What I am doing today is that I live life on lifes terms. I am going back to school fulltime, I speak publically about HIV, I educate students, employers and companies about HIV. We all have the responsibility to educate our peers and to be proactive in our healthcare and lives.

u have no lawsuit....... sorry to say. not that i agree with what happened to u but when i took over scheduling, i distinctly left a note saying that once schedule was up, it was up to you to find a replacement. i had no problem but if u and ur replacement didnt show up, you would both be written up. that being said, im not a prick and i accomodate as much as possible but still we have jobs to do...

that being said, i am sure u did get fired due to ur illness. they were just creative and sneaky

well I won the first round when they contisted my unemployment benefits with the county but the $$$$ stopped and now I have to do a phone conference at the end of the month. I was shocked when they said I was fired for mis-conduct, using coupons for myself. That is not how the conversation went. I was fired for not processing coupons and rewards according to lp rules not our store rules. THEY LIE...THEY LIE....THEY LIE.
i MISS MY JOB....everyone has been warned not to speak to me...I do have friends. Anyone know who the 3-way phone conversation is with???? Will it be with the lp chick, store manager??? any advice would be appreciated. you all are the best

I can't beleive what you wrote John because its the same thing that happened to me! Exactly! I was told I would have to pay full price a CVS and that Walgreen employees had to go to Walgreens only for prescriptions if I wanted it to be covered, an anianxiety med just like you and my concerns about the total lack of confidentiality with the manager, and I too was told by the manager not to take my codeine cough syrup at work, when I picked it up. Yours and my story are completely the same! Now I am on Narcotic pain meds and I am sure the entire staff knows it. I wonder if there is a way to prove the confidetiality issues and sue thier pants off. I wouldn't know who to go to and its all circumstatial unless the pharmacist who was there would agree to testify on my behalf. Totally doubt that, lol. I just had to comment on your story as we endured the same exact thing!
