Any comments on the new contracts for o/o's?

We were told to sign it before 5/20 or our contract would be terminated and we would be sued for not completing the contract. They reduced our fuel surcharge base rate by 2 cents per mile. It approximates a $100 plus a week pay cut, right before the prices skyrocket for the summer.

Just curious, What other concessions did they put in the contract? Also, I know Moyes is in deep trouble with Coyotes and NHL, how is the effecting Swift?

The one that kills me is in section 21 paragraph H. It states "CONTRACTOR WILL NOT DISPARAGE COMPANY OR COMPANY"S SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS".

This may disparage the company, but what a CROCK! So now we supposedly give up our right to the first amendment. If I were to post how I've been treated at times, it would be disparaging, but true!

They should put the same thing in for company doing that to employees under threat of lawsuit.

Either way, once any part of the contract is deemed unlawful, only that portion is null and void.

Swift can say anything they want in the contract. They can say they want your first born. If you believe they will hold you to it, you won't do whatever they say.

Its up to you to know your rights. Swift has lots of lawyers working for them. Don't let them push you around.

One other thing you might not have understood in the contract Section 5-a it reads "WHILE OPERATING UNDER COMPANY"S AUTHORITY, COMPANY SHALL HAVE EXCLUSIVE POSSESSION, CONTROL AND USE OF THE EQUIPMENT DURING THE TERM OF THIS AGREEMENT".

If you did not know, the tractor, your tractor, that you are paying on is THE EQUIPMENT!!

I asked swift about this, they said its in there in case you don't/can't make a delivery. It gives them the right to take your truck and make delivery.

Luckily, my wifes name is on the title, and she is not subject to any of swifts B.S. Rules, I have already informed her, if anything happens to me, and swift tries to take truck, call the police and report she is being truck-jacked!!

Well the whole point is read and understand the contract.....

My husband just signed his O/O contract. He is not happy at Swift but with the economy the way it is we felt that he had no other choice.(for now). Swift has left us in a horrible situation without health insurance when they up and cancelled the insurance on April 1, 2009. For those O/O's who do not have a pre-existing condition or who did not use the insurance then it probably did not matter. To us it was a tragedy!! Now we cannot get good coverage and are on the verge of bankruptcy due to medical bills. THANKS SWIFT.
My name is not on my husband's title and I suppose we need to make that change-just in case.
What if we were to change the locks? Our truck is paid for--how could they take the truck if he can't finish a load? Can't he just drop the trailer someplace? I don't understand. Could someone please clarify?

If your trk is paid for then they cannot take your truck.

It's my understanding that if, for instance...

You accept a load delivering to phoenix, you get there early and go to terminal. you either have a stroke, or you get pissed at swift. either way the load is not gonna get delivered. Swift COULD take the truck and make delivery. To my knowledge it has never happened, but what do I know.

as long as they have the title on the truck, they can pretty much do anything they want. If you have the title they have no rights to it. Thats what I was talking about them telling you things THAT ARE NOT TRUE!

Just cuz its in the contract does not mean its gospel!!
