This is old news. It was already understood that a new trial was in the works. MTA may not really want all issues to be on the table, including phase 2 allegations(whatever they may be). I would see this as a win for Mattel as nearly all issues seem to focus on wrong doings by MTA. The charges made by MTA against Mattel involving spying on MTA and other toy companies absolutely need to be brought to full light to the extent that they are relevant to the case.

Nice typo in your headline. Are you saying the Mass Transit Authority (MTA) is somehow related to MGA's Bratz line and Mattel?

This was no big surprise, really, coming on the heels of Judge Kozinski's ruling. Given that the fight has now spread abroad (where MGA and Mattel are fighting over discovery in Germany) the writing on the wall says: the case will be compared to Bleak House when it finally collapses in an exhausted heap ten years down the road. Barbie will no doubt survive, but only time will tell if her big-head cousin has staying power.
