Assistant Store Managers or a Zone Managers rights allegedly have been violated and these employees may be entitled to back overtime pay

The California labor law firm Blumenthal Nordrehaug & Bhowmik filed a class action lawsuit against Lowe's HIW, Inc.,(“Lowe's”) alleging Lowe's wrongfully classified their Zone Managers and Assistant Store Managers as exempt from overtime and therefore failed to pay overtime due to these employees. Valle, et al. vs. Lowe's HIW, Inc., Case No. CV-11-1489.

The Class Action Complaint alleges that the Zone Managers and Assistant Store Managers spent the majority of their time performing non-exempt work tasks throughout their shifts. The Complaint further states that these employees were given a managerial title, even though they spent little to no time performing managerial work and worked well over 40 hours a week and sometimes as high as 65 hours per week.

Lowe's Assistant Store Managers or Zone Managers who work, or have worked in California, may have a claim for overtime wages due to a misclassification as exempt employees attorneys for Blumenthal, Nordrehaug & Bhowmik assert in the Complaint.

This will go nowhere fast. Our job description is clearly exempt level. I don't know how any ASM could argue they aren't exempt. There are a lot of lawyers out there looking to make a buck from a settlement and FLSA classification suits are the new lawyer fad. This is just stupid. Next it'll be a store manager.

this law suit is old as shit and just popped back up on the net for some reason .the plaintifs appeal to vacate arbitration award got knocked down on appeall in 2012 and the law suit is dead.call the law firm if you think its still active

It popped back up on this forum because Alvarez (Bunker) is begging for much-needed attention..
Any thread started by this pig or any other name he is using from Schnooksville should be deleted or ignored.

I don't know. It may have a chance. Here in ca. walmart went through this type of class action law suit a few years ago and lost. Reason being, salary managers were spending more than 50% of their time doing non managerial task such as running forklifts, setting planograms, end caps, throwing freight, unloading trucks, getting carts etc...... They are now all hourly instead of salary. It can happen.

Well I tell ya what. The HR managers are definitely mis classified as exempt. Go take a look at what qualifies as an exempt employee according to FLSA. Don't know about the ASMs, but HR should be a non exempt position. Look up the lawsuit that LP Managers filed a few years ago.
