Kmart filed a lawsuit Tuesday against The Kroger Co., Eamp&A Southeast Limited Partnership, Fulton Improvements LLC, Kansas City Southern Railway Co., the city of Corinth and the Federal Emergency Management Agency.

It's asking for a jury trial, saying that various acts by the defendants caused severe flooding and heavy damages to its store at 118 Highway 72 West.

The lawsuit claims that the Kroger store was built in a floodway and should have been leveled but in 2005, it was permitted to remain after FEMA issued a Letter of Map Revision, through involvement by the city, Kroger and its landlord at the time, E&A.

Flood waters allegedly were caused by Kroger's location, the city's dirt landfill next door and the railroad's failure to keep a nearby underpass clean.

The lawsuit blames Fulton, Kroger's and Kmart's current landlord, for failure to prevent the problem.

Kmart also claims that Kroger's location altered the area's drainage from "standing water to a rushing, forceful water flow."

Before it filed suit, Kmart advised the city and FEMA about its damages. Its claims were denied.

SO, they are just now filing this lawsuit, what did they think that after the flood last year that fixin the store back up yet doing nothing to fix the flood problem with the possibility it may happen again nothing was done, so in other words they are pissed because it's happened again and they are out their money yet again so lets point the finger at someone else for your bad choices and make em pay....ugh...things like this keep me laughing some people can be so ignorant...like...why wasn't this filed last year??? Hmmmmm...

I dont do the Wal Mart thing. I like the K Mart thoe. They dont turn the Mexican labels out like Wally World. I aint been to Wal Mart sence I saw all them labels turned Spanish side out and boy I'll bet those stock holders miss me.

again??? they only flooded once! they DID NOT flood again in this last rain, precautions were taken

that is what im saying...but the water wasn't near as bad this time but why did they file it after they had to "take precaution" this time? makes some sense to me

The city has a lot of to blame because of flood water. Hope K-Mart does get some money as long as the rest of the people that received damage. City has done a lot of cover up not real work to fix problem. Half way cleaned out ditches and drains. What happened to money they received to help fix problem not enough work compared to money received. The City leaders all talk and no show. New Mayor and board no better than last one all horse dung no pun intended Mr. Mayor you of all people should be well use to be standing in dung.

Kmart is suing first of all because the city, fema, and the owner if the building didn't do anything to prevent another flood except clean out sone ditches. It is not the first time they have had water issues. Second, fema and the city could have closed the building like they did sam goody, but made changes on the zoning map to keep it open. Kmart is trying to keep a store here, you can't blame them for wanting to insure there future here.

What's funny is that back in 2005 when I took over the store, every time it rained my DM, Uncle Lloyd, had us put 40lb bags of dirt around the receiving area and all the doors because the store had flooded in 2003. The ditch out back has always been an issue and no one wanted to do anything about it. Good Luck to the new manager, give my regards to Uncle Lloyd.

At least Jason Null got out of Kmart alive. The company has been trying to default the landlord over a variety of issues for years, like every time it rained the roof leaked. Oh, and by the way new manager, get everything in writing, and don't let them change anything that will screw you out of your bonus. You'll need it to get home someday.
