This entire business of Key bank going after David Oringdulph personally and his trust, is hypocritical. David is a good person who has built thousands of homes and his track record is pretty much flawless. Like everybody else, he made too many presumptious deals and got caught. Now the bank is suing him??? Not because he did not complete his ventures (which he is well capable of performing), but because THEY THE BANK ALONG WITH HIM made a bad untimely loan. Let us not forget that THEY were the ones in power to either withold or hand over the money. Now they want to blame the developer for THEIR equally bad decision and loss. In my opinion, David should have the right to sue them for causing him a loss (I doubt that would have a a valid legal precedence). If I was the judge in this case, I would tell the bank to just take their ball and go home.
