A California jury has heard opening statements from attorneys in a lawsuit over whether a now-withdrawn hip replacement device from a medical giant Johnson & Johnson subsidiary was defective.

Just an additional information, news reports have it that there is now an increasing number of DePuy ASR lawsuit filed against Johnson and Johnson because of the defective hip devices they marketed from 2003-2010. Johnson & Johnson has been a major player in the medical device industry but has also been under fire because of consistently growing problems purportedly related to their products. Since the publication of this report, much has already happened. The plaintiff in this case was awarded compensatory damages of $8.33 million. Based on reports, hip replacements are associated with some complications especially with that all-metal hip implant. Many of its recipient filed lawsuits against its manufacturers for adverse effects they experienced which include inflammation, pain, loosening of hip implant, and metallosis. This story is similar to others that have transpired before it. As of now, there have been dozens of defective hip replacement lawsuits that have been settled where the company that sold the defective implants have lost. Whether the result will be go in favor of the defendant or the plaintiff remains to be seen, but considering that implant in question was recalled already due to large reports of its defective nature, the outlook does not look good for the defense.
