Aquila takes power-plant case to state high court
Aquila Inc. appealed today to the Missouri Supreme Court in its fight to save its South Harper power plant in Cass County.
The filing came two weeks after a state appeals court ruled against the Kansas City utility, which built the $140 million plant near Peculiar without getting zoning approval.
The new Aquila motion says the court determination to destroy the plant is not only incorrect, but one that would 'result in a colossal waste of resources and significant harm to consumers.'
The case also could be reheard by the entire appeals court. So far in the long legal battle, the lower courts have found in favor of Cass County. Read more

Aquila keeps stating that they only needed the PSC approval. That is wrong as wrong can be. The judge, Dan Dandurand's judgment stated that Aquila needed 2 things, the County's zoning permit AND not OR the PSC approval. Both of these things are required before a power plant is built, not after.
There is no truth in what Aquila is espousing. They erred and now need to pay for their errors. Threatening the customers by stating that the customers will have to pay is also a lie. These mistakes can not be passed on to the customer.
