Last summer I went to a Bally's in Philadelphia. I mistakenly did give them my credit card information, but they assured me I would not be charged until I agreed on becoming a member. I called them the next day and told them that I was not interested in membership. I even have a copy of the contract, which I never signed. However, the charged my credit card over $80 a month for 3 months before I noticed the charges and notified my credit card company that this was not authorized by me. Now, I have been contacted by a debt collection company saying I owe them almost $3,000. I called Bally's and they said I did sign the contract, even though I did not. What should I do in this case.

I totally agree what is going on here. Why don't everyone of us file a law suit together? same thing happened to me and I am cursing myself that y didn't i read these comments before. But anyways, can anyone tell me which group is filing a class action against them and can we join them?

I've repeatedly complained of disgusting for lack of a better term (music)
The song of the day today was a nice one, especially since it's piped into the children's day care room. The lyrics went, don't want no short dick man, repeat don't want no short dick man over and over, with interludes of put that little thing away, put that little thing away.
I've complained to the manager as have many others, but it is still being played. I've written a letter to corporate. I just got a smooth over letter in return. Don't go to Bally unless you can handle crap music, or have very good ear plugs, and don't mind seeing little children playing to this ghetto crap.

In 1998, I had move to another city and the gym I belonged too was too far away and Bally’s was building a brand new facility less then two miles from where I live. I had heard about Bally’s bad business practices, especially about the three-year contract lock in, however, I still decided to join because it was a beautiful gym and I knew I would be there for a minimum of three years.

I read and signed the contract, paid the full three years up front (total was about $850) as a premier member. Since I heard about the business practices, I refused to give them my credit card, instead, I wrote them a check for the full amount, had them initial the contract to make sure the amount was paid in full by check. After those three years when they send me the annual renewal ~$100, I always send them a check. So far, okay.

The gym is still in good condition and every few years, they swap out cardio machines for new ones. As for the staff, what I can say – I agree with many of you folks – most of them are lazy, and basically they ignore most the members there unless you’re young, buff and cute, but I’m there to get a good workout so most of the times I ignore them too. My biggest complaint is the volume of their music playing overhead. There are times the music so loud, I can’t hear my own music, even though I wear the noise-canceling ones. When it gets to that level, I tell them to turn it down – some staff will while comply but many of them will argue with you and tell you that the volume is set at that decibel – give me a break – like I really believe that – just turn the darn decibel down - I swear – the louder the music – the lower the IQ of the staff.

OMG, I got a doctor's note today. I was totally honest with the MD, seeing as how i dunno what illness I should fake to fool an experienced MD. So anyways, I told him about Bally's BS contract. My 3 year contract is up in December of 08. But I am fed up with Bally's. I called the 800 number and told them that I was willing to pay whatever cancellation fee there was, and the customer service rep basically said "No!" I have to move more than 25 miles away from the nearest one (which in NYC is impossible)OR get a doctor's note. Well, i got the doctor's note saying how my feet are messed up and I cannot do "prolonged walking, standing, or physical activity". For legal reasons the doc didn't wanna put anything down with regards to gyms or Bally's, which I totally understand. I am goona mail this in and if doesn't work, I will threaten Bally's with a call to the NYS attorney general and the better business bureau for not cancelling due to injury. Ballys' is ridiculous! And I was willing to pay a cancellation fee! I hope Ballys and Crunch go down in a blaze of fire!

My story's not so bad, really: I sent in my cancelation the day after signing up, and they charged me for months. I've been in touch with customer service who want some proof of my having sent the cancelation in, which I don't have. Hearing from all of you, I'm now pissed. I was too nice. I'm calling in a little while, and raising hell.

Lisette, if you never signed the contract and have the original, then fax AND mail them a COPY of the original (by certified mail of course) then do the same with your credit card company. If Bally's continues to harass you, contact the Better Business Bureau, Consumer Affairs and the State Attorney General in your state. Ballys cannot charge you for a contract you didn't put your signature on.

I am seriously considering taking formal legal action against this company. I canceled my contract, was given the runaround, and said I owed something like $300 and it would be withdrawn from my account until that was paid. Well, that was paid off quite a while ago and they continue to withdraw money from my account, in varying amounts. Some months its $25, others its $41, some its $15. Called and was told to fax in the letter I got stating my contract was canceled due to medical issues and that the balance owed was $300. I doubt they'll ever get it, and if they do, they'll claim they won't, or can't do anything. I can't believe this company is still in operation...what they are doing is illegal (yes, some of their actions are legal, but highly unethical) but they are still doing things that are downright illegal. They seriously need to be sued for all they're worth.

I also have an issue with Bally Total Fitness. The person I spoke with when signing up told me that I can cancel my membership anytime, and since I was really hesitant to join, he told me I should try the trial period. Which I paid 15 dollars for me and my mother and father. Bally just recently charged me about 81.14

Oh while i was writing this, I called the corp. they told me that I will have to go for 17 days and then send a letter to the cancellation department. Then pay a 50 dollar fee which I am really willing to pay to cancel and that be it. I will make sure to call my bank to stop payment for bally which LALALA stated. Ill tell you guys how it goes after my 17 days of hell.
