Whoa, now. How can there be no restrictions on speech except when you harm someone. Isn't that a restriction?
Just as there can be no penalty for murder...until you commit it.

You don't get it, Che.

What you leftists want is to penalize law-abiding citizens who have owned guns for decades without harming a soul.

I agree. So let's be clear. The second amendment garauntees us the right to bear surface to air missiles and mustard gas, right?
They are no restrictions. But, I'm curious? Is this a problem? Are there large groups of citizens hoarding SAMS and mustard gas? I haven't heard about these events. Are these the specific arms that the NRA and US gunowners are clamoring for?

Or...have you simply resorted to the absurd...again.

What? What?

What in the name of the Very Funny Lord does that have to do with whether or not constitutional rights can be restricted?

You are realizing that your argumenet is a political one and not a constitutional one, aren't you?

Why don't we duct tape movie-goers' mouths closed before they go into the cinema?

You know...so they won't shout, "Fire!"

What's wrong with shouting "Fire" in a theater? The 1st amendment says that Congress shall make no law abridging the freedom of speech." What is ambiguous about the words "shall make no law?"

Not absurd at all.

This should be very simple. Should it be legal for you to own a surface to air missile that could take down any commercial airliner?

It is not restricted by the Second Amendment.
If you and 38/50 states think it should be, pass an Amendment.

In the meantime, carry chapstick in your purse.
That movie theater duct tape is brutal.

That was a very ambiguous post. Let's keep this simple.

Yes or no?

-tip- has an absolute right to own a surface to air missile.

As you've been told several times, there is nothing ambiguous about the phrase "shall not be infringed."

Why can't you just say "Yes, I believe one has an unfettered right to possess a surface to air missile?"

That's exactly the point. Some folks seem to be under the mistaken impression that the rights conferred are absolutely unlimited, and not capable of being constitutionally regulated.

That's simply not true.

Why can't you explain why we don't slap duct tape on the mouths of movie-goers?

Why should we? It is perfectly legal to shout out anything that one wants to in that theater, isn't it?

You still don't get it.

The act of arms ownership harms no one.
Just as my mouth being capable of [i.e., unrestricted] for speech harms no one.

Depends. If they think the car would move or evidence destroyed by waiting on a warrant, they can search it. If it's an abandoned car that can easily be secured, there is no reason not to get a warrant.
