Well Hassan actually admitted he killed all those people because of his faith so it kills the whole workplace violence argument.
Now if they catch the people who beat this guy up and they admit they targeted him because he was gay then yes charge him with a hate crime. Maybe though they just wanted to beat the hell out of someone. It doesn't say if he was robbed or not.
