It's very bold of you to assume that she wasn't paying attention, that she might have been on the phone or following too closely. Have you never been driving down the road when something has fallen off the back of a pickup truck or utility trailer, or a semi has suddenly lost the tread off of a tire. I recently had to swerve to avoid a piece of concrete kicked up by a truck. I wasn't speeding, I wasn't following too closely, I wasn't talking on my phone. I was paying attention. I was in a different lane and the concrete came across my lane.The SUV driver claimed to be swerving to avoid 'debris'. I say if she had been paying attention to the road instead of phoning (maybe) and following too close (probably) then she would have had time to react safely.
