MIAMI (Reuters)- A Florida man appeared in court on Wednesday to face charges in the shooting death of an apparently unarmed black teenager in a case putting Florida's controversial "Stand Your Ground" law back under the U.S. media spotlight less than a year after the killing of 17-year-old Trayvon Martin.

Michael Dunn, 45, is being held without bail on charges of second-degree murder for the Friday night shooting of Jordan Davis, who was also 17.

According to authorities, Dunn pulled into the parking lot of a Jacksonville, Florida, gas station alongside the SUV where Davis and three friends, all of them young African Americans, were listening to music.

Dunn asked them to turn their music down and, after an apparent exchange of words with Davis, he produced a gun and fired eight or nine shots at the SUV. At least two of the bullets hit Davis, causing his death.

Dunn, who was in Jacksonville for his son's wedding, sped off after the shooting but he was arrested on Saturday in Brevard County, Florida, police said.

Dunn's lawyer, Robin Lemonidis, told reporters that someone in the SUV brandished a shotgun and Dunn opened fire on the vehicle in self-defense.

"It will be very clear that Mr. Dunn acted responsibly, and as any responsible firearms owner would have acted, under these same circumstances," Lemonidis said.

She could not be reached for further comment on Wednesday but appeared to indicate that Dunn will invoke Florida's "Stand Your Ground" law in his defense.

The law gives legal protection to anyone, anywhere, to use deadly force in a case where a person is attacked and believes his life or safety is in danger.

Critics say the law, adopted under former Florida Governor Jeb Bush after a big push by pro-gun advocates, has been used to allow some Floridians to shoot and kill with impunity while also encouraging vigilante justice.

The law fell under a firestorm of criticism earlier this year when police in Sanford, Florida, cited it for their initial refusal to arrest George Zimmerman to face murder charges in the killing of Trayvon Martin.

Police say no shotgun or other weapon was found in the SUV where Davis, a high school student, was shot and killed.

Formal charges against Dunn will be filed at a court appearance set for December 19, said Jackie Barnard, a spokeswoman for the State Attorney's office for the Fourth Judicial District of Florida.

"The investigation is ongoing and we're waiting for the sheriff's office to finish their investigation," she said. "We'll review the evidence and the State Attorney's office will make the appropriate charging decision."

And if Obama had a son, he'd look like Jordan Davis.
Buckle up, folks.

One less mouthy punk running the streets. This group of juvenile delinquents should have just turned down the music like they were asked instead they wanted to get belligerent and threatening. This guy should have taken out a couple more while he was at it.

“Meh.”

Amazingly disgusting. While it would be great to see the death penalty eliminated, till it is, one can hope for it being applied equally across class and race lines to include people like this.

Why are these young Black men loitering in a gas station in the first place, being rude and loud and possibly driving away potential customers?

To me, Black youth were gloating (like the Black posters on the forum) over the "victory" by Obama and mocked this gentlemen by not during down their vulgar "gangsta" rap music. However Mr. Dunn was "done" with their ghetto culture and decided to go "Dirty Harry" on the home boys.

We are now two or more nations with different culture, values, language and morals. Black youths are very arrogant and this White Man has served notice, that like Zimmerman, he is tired of being "disrespected."

"Please turn down the music" by Dunn is much like Zimmerman asking to "see I.D." But with the Black ghetto hood rat entitlement attitude is both arrogant and stupid and once again has paid the price.

Zimmerman wasn't white until the left said he was.

Really???

Any responsible gun owner is likely to pull into a gas station, pick a fight someone whose music he doesn't like and then start shooting?

The police said there was no weapon found in the SUV. Dunn fled the scene. Anyone check his blood alcohol level? I hope so.

You think that a guy with a gun that he pulled out and started shooting was likely to have approached hat in hand to say "please turn down the music?"

You are reading stuff in.

Just like you are reading in that Zimmerman asked Trayvon Martin for ID. Not only does Zimmerman have no right to cruise his neighborhood asking random folks for their ID, he has never claimed to have done so.

Dontcha just love the things people say?

Similar to Trayvon Martin, Davis was 17, unarmed and African American.

But Dunn's attorney said her client's action should not be compared to George Zimmerman, the volunteer neighborhood watchman who is charged with second-degree murder in the February 26 shooting death of Martin in Sanford, Florida.

"That's ridiculous. Michael is not a vigilante," the attorney said. "He's a brilliant software developer. It was never his intention to kill anyone."

As if brilliance in software make one immune from vigilantism.(notice--the lawyer categorizes Zimmerman as a vigilante, something HIS lawyer must be upset about today).

And then she says it was never his intention to kill anybody. What exactly did he think was going to happen when he pulled out his weapon and started firing?

We have simply got to get over this gun-thug mentality.

The only thing Dunn is guilty of is wasting ammo. Eight rounds and only one dead two legged rat?

This is disingenuous as you and your ilk (Female, MNFP1979, Day Star, many others) are the one's who are behind all this gloating by young Black Males.

Dunn shows that even computer nerds and geeks are going atavistic and fighting back Ted Nugent style. The home boys and hood rats better get a clue and soon and turn down their music and pull up their pants!

Reader please be fair and balanced.
