I hope Kasich does an overhaul of ODJFS and the UC Review Commission. I filed an application on 6/27/10 for unemployment. ODJFS listed my application date as 7/4. The difference in the dates changed the base periods & qualifying weeks for my claim. The online claim summary showed that I filed a weekly claim for the week ending 7/3. It took 1 month of countless phone calls for ODJFS to recognize the correct application date.

I was then told that I still did not have enough qualifying weeks. I faxed & sent my paystubs numerous times to ODJFS & the Redetermination Unit. It took over 2 months for the information to be corrected.

My claim was then disallowed because it was determined that I was discharged for just cause because my unexcused absenteeism demonstrated a disregard of the employer's interest.

I called & faxed my employer on 6/23 to report that I was calling off 6/23 thru 6/25 because I had a contagious condition. I had a Dr's appointment on 6/29 and stated I would give
them a medical excuse at that time. My employer terminated my employment on 6/25.

After receiving the notice that my claim was disallowed, I contacted ODJFS to find out why my former employer did not submit a valid Eligiblity Notice in writing as per ORC 4141.28(F) within the 45 day timeframe of my 6/27 application. I was told that ODJFS did not have to contact the employer until I established eligibility for my claim. The employer was not contacted until 8/25 and then the statement was given over the phone.

When the employer was contacted on 8/25 at 11:26am, he stated that my separation was due to job abandonment because I failed to call off for the week. This information was given to me by ODJFS on 8/25. I contacted the employer and he confirmed that he stated that my termination was due to job abandonment for failing to call off. I told him that my phone records & fax confirmation would show that they were contacted on 6/23

I spoke to a representative at ODJFS on 9/10 and asked that the Employer's Fact Finding Statement be read to me. It stated that I did call off on 6/23, but it was unexcused and that I failed to call off for 6/24 and 6/25. I requested that a hard copy of that statement & it was sent on 9/16.

The Employer's Questions on the Fact Finding Statement are blank. The additional Employer Information was entered on 8/31 at 8:51am. The Director's Redetermination was issued on 8/30 so ODJFS changed the Employer's statement after I stated I had documentation to prove I contacted the employer.

Though I filed an appeal to the UCRC within the required timeframe, they sent my claim back to ODJF. I was told by an attorney at UCRC that ODJFS can choose to ignore my request for a corrected determination.

My online claim summary has been changed to show the incorrect application date of 7/4/2010, which would not give me enough qualifying weeks for that base period. My weekly claim summary information has been deleted from my online account.

Fortunately, I printed out screen shots of my weekly claim summary with confirmation numbers and recorded all conversations with ODJFS, the UCRC and my former employer since the beginning of this claim.
