Personally, I feel that banning a type of private legal arbitration because we feel that it's bad for women involved is near criminally patronizing. While I've long been concerned over the vastly different results different types of private arbitration can return in civil and family cases, pretending that one population of women aren't able to fully consent to contract into this arbitration seems paternalistic and patronizing. I don't feel that I'm able to tell someone that they shouldn't have the same range in legal processes than I am, because they may choose a different venue than I might.

I can never tell if "we need to stop it for the women" excuses are just poor veils to xenophobia or if the folks doing the yelling don't actually understand the opt in nature of the court processes. Usually, I fear that it's both. The reasons people put for being afraid of Islamic courts mirror 19th century panic over the presence of Talmudic courts in the US. It's all rather exhausting, rather sad and requires either ignorance or self delusion in a degree which I fear is more than I'm able to supply.
