I read it. What you've cited above is the opinion of a Republican Economist, not a Constitutional scholar. Mr. Roth, though completely untrained in law, as a former regulator for the FCC should know full well that regulatory bodies like the FCC have the Constitutional authority to impose fees such as the one Obama has proposed, without getting Congressional approval.

Your viewpoint is more than just a bit flawed. You look at complex issues and see only black and white.

That most certainly is not a proper analytical stance for someone to take when looking at issues of Constitutionality.

The White House press corps laughed when President Obama's spokesman on Wednesday said the president, in directing the Federal Communications Commission to raise cell phone taxes to pay for broadband Internet access in schools, would not be going around Congress.

"The FCC will decide whether another tax is applied? You're not making an end run around Congress in this case?" a reporter asked fill-in White House spokesman Josh Earnest.

"Well, I --'end-run' is not the word I would use. What I would say is that there has been --(laughter)-- what we have seen from Congress is, we've seen a lot of stagnation and dysfunction and an inability to act on some rather obvious priorities of the American people...."

I don't think Duke denied it was an "end run" around congress. He denied it was a violation of the constitution. Pay attention.
