Years ago a guy I knew used to talk about something he called The Citizens Justice League. His idea was to have a group of trained, well disciplined people with excellent long range shooting skills to deal with the likes of this murderer if they were released from prison. Maybe he was closer to the mark than I thought.

The article states "Gunnell was convicted violated her right against being tried for the same crime twice." Since the earlier trial was never completed I don't know how it could be considered double jeopardy. God, these judges are pathetic.
Gunnell's sleazy attorney almost sounds happy that a man is dead and his client is getting off light.

I don't think she should have been let out but I do have to ask the question" How many times does it take a prosecutor to have a correct trial?" In Clark County it looks like 3 times. What a waste of taxpayers resources. Some of the comments sound like y'all have been watching too many old TV western shows.

Odd a series of never completed trials invalidates the third succesful one. Ok it seems wrong to me considering people are found not guilty in cases then the feds step in try them under hate crimes. Seems those cases are more of double jepardy than two mis trials invalidating a third for the same charges.

I agree with you! Changed my arse!! She won't be able to get a job, tax payers get to pay for her to be a lazy arse and she will be back out there shoplifting again and killing someone else! To bad the sleazy attorney wasn't the one she killed!!!

Wouldn't a trial have to be successfully completed all of the way through before a double jeopardy charge could even be considered? Good Point.

These judges that overturn proper convictions need to stop being activists. They're scum and should get to spend time with these same people they are "saving" from prison.

Why don't we just abolish all prisons, because they're cruel and unjust punishment.

We've made it a bigger crime to mistreat animals than to kill our own kind. So pathetic we have become.

As frustrating as it is to see guilty people go free, protection from double jeopardy is a right that has to be afforded to everyone. If the government could pick and choose who has the right to be free from double jeopardy, the 'right' would become useless. This is one of the freedoms upon which our country was founded. This is the price we pay for due process and protection from unfair government actions, that sometimes the guilty will go free.

Im kinda surprised she didnt play the "I was in the wrong place at the wrong time" card... it seems thats what all guilty people do.. and for her being a "Changed" person, i call BULL S***.. lets be honest, she will be back in prison where she belongs in less then a week after she is released.. Just remember, you can take someone out of the ghetto, but you cant take the ghetto out of them....

The rule is that jeopardy attaches when the jury is empaneled. This decision is ridiculous. If the judge hadn't dismissed the misbehaving juror, they appeals court would overturn the conviction on those grounds. This is an obvious case of the decision preceding the reasoning. I doubt it will withstand an appeal by Clark County.
