I don't understand the judge's statements. Supposedly time was of the essence in Umar's hospital questioning so it was OK to violate his rights. It doesn't take thirty seconds to recite the Miranda statement. I don't think this will hold up to an appeal. There is certainly enough outside evidence the Umar committed a crime even without his statements. The statements only serve to officially place him into the terrorist category where he belongs.

The Supreme Court exception came about from a case where the police were searching a suspect and found an empty gun holster. Police asked the man where the gun was before reading him his rights. In the heat of the action you can see how every second could be important to prevent further injury.

Meanwhile, with Umar resting in a hospital bed and under drug influence, it does not seem that another 30" would have caused a security risk to the country.
