Interesting. So the university is immune under common law and cannot be sued, and the "evidence" collected has been turned-over to the Commonwealth's Attorney's office. So why then were the UVA police the ones doing the search & seizure? It looks clear to me that the university wants it both ways: They are not involved so don't bother them with lawsuits, yet their quasi-governmental henchmen were directly involved. Which is it? They can't have it both ways...

Just another case of someone being tried in the accommodating media. It looks like the university, in cahoots with the local media want to be sure Prof Allaire cannot get a fair trial.

When there are no legal grounds for dismissal of a lawsuit always go with the old stand by "frivolous lawsuit"....does not merit the courts valuable time and effort... frivolous covers a multitude of legal smoke and mirrors moves.....

Maybe I'm wrong, but wasn't the property taken at the request of the Albemarle Attorney Generals office, and wouldn't campus police rather than Albemarle police have jurisdiction to carry out confiscation of evidence on UVA property?

One of the previous articles said the evidence was taken from his home.

On the same search warrant (see bottom)

there are instructions to raid his office on UVA grounds, so that may be why the search warrant made out to "any authorized officer" was conducted by uva cops.

It sounds like the U is going to save its own behind. I guess the UPD will have to swing alone. Though I have friends on this force, in this case it couldn't happen to a better bunch. KARMA KARMA

This is an easy one. Law 101. If the university is a corporate entity (state entity) then, only the corporate entity unde the Public Trust can be charged with any alleged crime. The Private Person (common law) cannot - and as such Mr. Allaire is correct in the violation of his 4th, 5th, Amendment rights as a Private sovereign Person. Citizens are the Corporate. One must understand the difference between "legal" and "lawful" to obtain the Truth, or attempt to apply the Rule of Law. In addition, this article states "police believe" - which means there is an Affidavit of an Injured Party that was filed on the public record alleging a crime. Whomever the PERSON is that Filed that Affidavit under Oath - is the Plaintiff...so the "police" cannot lawfully nor legally be both the prosecutors and witnesses. Whenever a CORPORATE entity Infringes on the RIGHTS of a Private Person (not a Citizen)- they RISK a Civil Action (sovereign immunity is waived by the Agent)

Besides, no court can even consider a Demurrer, until the MERITS based on the EVIDENCE has been Heard and Ruled upon. This is a generic diversion ploy most lawyers use to AVOID the ANSWER to the Plaintiff's Allegations and violates Virginia Supreme Court Rules for the Courts. Again, Law 101. Either there is Rule of Law for All, or not.
