CLEARCREEK TWP., Warren County — Clearcreek Twp. Fire Chief Bernie Becker retired Thursday, June 5, preventing township trustees from contemplating disciplinary action against him. His retirement eliminated the need for the trustees to consider findings from an investigation by retired Montgomery County Common Pleas Judge John Meagher. In March, the local firefighters union accused Becker, chief of the department since 1997, of "improper touching, inappropriate behavior, hostile work environment, abuse of power, lack of operational knowledge, skills and abilities during emergency incidents." The trustees on May 22 appointed Meagher to recommend action after reviewing township police Chief John Terrill's investigation of the complaints. Until Thursday, Becker had been ordered to report to township offices while Terrill investigated the complaints, which included nine sexual harassment claims, some similar to those firefighters lodged against Becker in 2001. During Thursday night's trustees meeting, Assistant Chief Thomas Morrison handled administrative actions regarding the fire department. Becker was absent, having submitted his retirement in the afternoon, township Administrator Dennis Pickett said. Jill May, a lawyer representing the township, said Meagher never completed a report and Terrill's investigative report would not be released to the public. May and trustees declined to release reports from either investigation despite appeals by the firefighters union and the Dayton Daily News. Becker, chief of the fire district covering Springboro and Clearcreek Twp., couldn't be reached Thursday night for comment."
