Is there anyone out there that knows of estate cases which are DRAGGING out in the LC probate court system which are making the lawyers money while NOT helping and dealing with families pain and suffering? Especially those that have proper legal binding documents of Wills, Trusts, POA etc. We would really like your input.

We had the estate of an elderly relative tied up in the hands of an attorney in Tucson for two solid years before we hired another attorney and turned it over to him. The new fellow initially told us he would have it wrapped up by the end of the current month. It turned out the first guy hadn't even applied for death certificates or gotten the assets transferred over. He hadn't bothered to invest the money in a simple money-market savings account either, so we lost at least $10,000 in potential interest, probably much more. Because the new attorney had to apply for death certificates before he could get the relative's assets placed in a checking account in his name and get checks printed, it took six weeks for him to get our inheritance in our hands. The woman had had a different attorney draw up a good will and place all of her assets in a trust. It should have been a slam-dunk for the first attorney and done with in six weeks, as the efforts of the second attorney proved. Make sure your lawyer is working for you, not for himself. Look for a lawyer who is called a "certified private fiduciary." If your relative had a will, and it is taking many months to get the estate probated, consider you may be experiencing legal malpractice or incompetence. Get somebody else to handle it.

Oh Good Golly Molly, don't go given her fodder.
We really don't want to have this hashed out all over again, so let me sum it up in a few brief statements. The mother fell down the stairs and died from her injuries during the fall. The daughter(op) thinks that because her mother gave her a durable poa that it means that she has POA over everything that her parents owned. Her father is still alive and removed her from being his POA and now she is fighting him for control of all of his assets and claiming he is incompetent despite findings by his doctor and a clinician. She is the one tying this up in the court system and they are just trying to protect the old guy from being taking advantage of by his worthless greedy money grubbing children.
Please don't encourage her.

Hey the PO asked a reasonable question, I gave her sound advice based on my own experience. If you other interlopers have more information than I do, so be it. If the daughter lacks a will clearly leaving everything to her, that is an entirely different story. She claimed she had all the requisite legal documents. If that's not true, then that changes everything, and the court is doing its job. We have to asume people are telling the truth and being honest. If what you say about the father being alive and disputing her claims is true, it's not just the lawyer and the court dragging things out for their own profit -- which does happen incidentally.

For your language lesson for today, the word you want is scheming, not conniving. Officials connive at wrongdoing by looking the other way. Second, I have no interest in brains. Brains are a biological communication computer. Being machines, they are incapable of original, creative thought. All creativity and original thought proceed either from the mind, which is a nonmaterial, i.e., nonphysical, projection of the spirit or else directly from the spirit itself, which is nonphysical and immortal.

I respect other people's right to religious freedom so long as they don't throw their beliefs at me. Take your religion to church and talk about it all you want with others of like mind. I do not know "Lynn" or her situation at all. If you and the other insiders have all her personal information in your pockets, I'll let you have at it from here on out. I answered what I took to be an honest question with a straightforward and honest answer. If the OP misrepresented her situation, that is her mistake. I can't judge her because I don't know her. It would be foolish to take sides.

Molly, I will now teach you to read. Go back to my posts on this thread. Look for any mention of God, Jesus, or Heaven. Do you see them? If so, you fail.

I don't know why you rambled on about all for that, rarely do you read anything I say that has to do with religion.

I don't believe so. A person asked a simple question about probate courts dragging out will settlements exceedingly long. I am not in here that often but when I am it looks like MollyHigh has her nose in every post. The way she rambles reminds me of a person who does not get the time of day when trying to have a face to face conversation with another person which leads her to this web site to ramble about such andon things.
