Bob Morrow has been given a clean bill of health by Village doctor Vinny Boombots. The rumor that Bob had died was just that a rumor. The official Village doctor Dr. Boombots WD (witch doctor) has certified that Bob does have a pulse. Contrary to popular opinion he is really alive and not a member of the walking dead. He just looks that way

When you say All residents of MBV, don't you just mean homeOWNERS living in the original 10 sections?

and again, go f yourself. You better hope the judge doesn't go with the origami 10 sections or your SOL with taking the properties and waterfront.

He won't because the 9th and 10th sections were not part of the original deed.

Judge will rule based on past case law. Nobody knows what that will be. The appeal will drag on.
Meanwhile the community loses the millions of dollars that is currently sitting there waiting for a court decision before April.
This is a lose/lose. Everybody loses.
Here is my question.
Which candidates will agree to settle this case through mediation sessions.
Mediator is a neutral. Mediation site is neutral.
Let's make a lose/lose into a win/win for everybody.

Fine as long as both parties accept you as a "neutral".
Remember this is not an arbitrator. The mediator only facilitates bringing both parties to the table. It's up to both sides to come to an agreement.
Example: An agreement is reached where a bank escrow account is set up to receive all boat slip monies. In return the POA gets to keep the clubhouse, do the Crab Fest, etc. All shorefront becomes non-buildable parkland as per written agreement.
Lawsuit gets dropped. Lawyers lose millions.
Community gets millions to rebuild marinas. All property values go up.

Only the Shorefront currently held by the MBPOA. NOT the land being bought up along Riviera which is in private hands.

And, for use of the marina for the Crab Fest, a fee to the village commensurate to 50% royalty.

Let's get this settled.

and we can't have that. Only solution we'll accept is one where the POA loses, nothing else.3826

I put "example" only to illustrate my point. Which is both parties need to agree to come to the table.
I can't settle this case here. But a solution will require both sides to give something.
Mediate so that we can move forward and rebuild the marinas.Win/win for everybody.

The village gets the marinas. The POA keeps the clubhouse and land it sits upon. And to use the marina for a festival the POA pays the village a royalty or use fee. How is this not fair? Let's get this deal over with already. Any CASH will need to be monitored possibly by use of purchasing village dollars to stop money from being pocketed.

What do we need to do to get this settlement? The fighting won't end but at least the dust can settle.

Why should the village settle on any deal when the court will grant to them what is rightfully thiers . The village extended the olive branch to the mbpoa for three yrs. To be blown off . To hell with them

1) The judge could do the direct opposite of what you say. Only recourse then is appeal.
2) We lose millions of federal grant dollars if this isn't settled by April
3) This fight will never end. Why not mediate a settlement now and move forward with the rebuilding.
4) Elect trustees who will agree to give mediation an honest try. Which candidates are willing to come forward now before the election and agree to schedule mediation meetings?
I'm positive the judge in the case will strongly encourage this.
