Dayton R.C. 70.121 is the law they use to operate their red light and speed cameras. It requires that an “automated traffic control signal photographic system” be installed in conjunction with a traffic control signal, described to mean a traffic light,(Section B and A3) but the city has ten locations in violation of their own ordinance plus mobile cameras. They also require that a notice of liability list the location of the intersection and it “shall” be included. Shall is not optional under US law, it must be done (D 1 d). This also shows that the intent of the law was to only create liability only at intersections.

It seems pretty clear the law was written to allow this only from intersections with traffic lights, but Redflex and Dayton can't even follow local law. If that's not bad enough they went before the Ohio general assembly acting like Elmwood Place was an isolated incident. All they want is money, but you can fight to keep yours if the camera isn't at an intersection controlled by a traffic light.

The are fighting these scams and winning in Elmwood Place and New Miami, but I guess Leon has the people of Dayton feeling too discouraged to fight. Too bad I don't have a ticket to fight them on.

If you weren't smoking so much medical marijuana, you'd find a way to take care of that. Ohio is a presumed speed limit state. If your bus driver thinks it's a safe speed for a bus then the speed limit is too low. Make them set it right.

Are people in Dayton really so beat down that they won't fight it? We took care of Elmwood Place, you can fight city hall.

Did anyone see the news story on 45 tonight? Dayton's Assistant Chief of Police, Robert Chabali says that these are at intersections. It's like he can't bring himself to admit on camera that they are breaking their own city law.

People in Ohio's other cities are fighting this. Why is Dayton so beat down they take it and ask for more?

Mike Allen and his team are going to crush Dayton, and they won't even have to use this. It will make a nice back up case if the Montgomery County court is as corrupt as Dayton.
