I would like to know how everyone feels about this. Doe this seem a little over the top or is this how the Wylie Police operate. It was not a gun, it was not on me it was just in my truck.
Thanks.

I was unloading my jet ski at about 5:30 in the morning as I was going to have it repaired. I had to drop it off early because I had to be at work at 6:30 in Plano. As I was undoing straps etc an officer pulls up.
I will just cut to the chase now. After 40 min of what is this, what is that, when did you buy this and them calling all kinds of people to confirm it was my jet ski, they finally arrested me for pepper spray. Which as you said also it does not define what is a small amount. I didn't know it was to much. I have never heard of anyone being arrested for carrying pepper spray. Also I was very courteous throughout the stop.
Thats kinda funny, It seems that our tax dollars are not being spent the right way. I have called the police and ask for something to be done about the young man selling drugs next to me. He does not tried to hide it he just sells. Im not an old, decrept, I know when people are doing wrong, Im not going to let this happen. What do we as citizens have to do to get this crap stopped. I have called the cops several times and it seems to do no good.

I have been in the Wylie area for a year now. I've been pulled over twice, once for speeding and once for expired tags. I WAS ARRESTED BOTH TIMES!!! The time when I was pulled over for speeding the officer pointed out to me that my license expired a couple of weeks prior and arrested me. Whats more, I was in jail with three other guys also arrested for an expired license. I had four kids at the babysitters house when this happened and I don't have a wife. NOT SUSPENDED... expired. When I got to the jail the officer that fed me breakfast in the morning told me that they will arrest you for anything in Wylie except for speeding and open container. I think these cops are just too overzealous in this town and need to take a step back and realize that they are screwing people's lives up when they arrest us for something that anyother jurisdiction would just ticket us for. You can usually bet that if you see someone pulled over in Wylie, they're going to jail for SOMETHING. I call for an uprising of this foul system. Lets get someone in there who actually cares about the citizens and who wants to see the people succeed. By the way, how can I find out the ratio of traffic stops to arrests made in Wylie?

It's time to get a life and quit trying to find everything that is wrong and look at the ratio over good things being done vs. not. Who will you call first when you need help with someone trying to do you or your family harm? The police. Some people need to get lives! Get a new hobby besides trying to bash the police. Try knitting or reading.

Why did you have a scanner in the truck? Not that its illegal or anything but that is suspicious to LEO. Crooks use those. Something made them suspicous.

You had a police scanner in the truck, a speaker phone on your truck, a boat in a trailer for wheeled vehicles, what else?

What do you use those items for? If they found rope, duct tape and a bat in my trunk, no matter how good I am, I am getting the treatment.

Popp = typical sheep moron. So police shouldn't be accountable for their mistakes.
Good luck calling police when someone is harming your family. Have you even ever called the police? The police are really good at showing up 45 minutes later when the criminals are long gone. Police are not employed to prevent crimes. They are employed to document crimes and make arrests after the fact. If my family is threatened then I will handle it myself. Of course, in Texas that means using lethal weapons as non-lethal weapons are frowned upon by state laws as well as by the police.
Last time I called the police was for three 10 year olds I saw entering a construction site (school being built) and was worried about their safety. The police showed up right on schedule (aka 1 hr later) and proceeded to pull AR-15s out of their trunks and then entered the premises like they were laying siege to Bin Laden's hideout. Of course, the little kids were long gone by that point.

The police actually killed an elderly man there by using pepper spray on him. The poor guy was just walking on his sidewalk. He had a heart attack after they put pepper spray in his mouth. They pulled my sister and I out of a car accident by force. I thought they were going to beat me, my sister was bleeding and unresponsive and the dragged her out on to the ground. They guy who hit our car was probably drunk but he got off because he knew the police. Don't live in Wylie.

I live next too the city of Wylie, not exactly happy about it either. Having experianced on more then a fwe occasions how corrupt, useless, and well lazy and stupid most of them are, I am not surprised they arrested a man for all the wrong stuff.

I will elaborate. I lived in the town for almost 4 years. In that time i had a cop get mad at me for eating my dinner on an apartment patio, cause i had a butter knife and that can be contrued as a weapon. Its always nice when you are eating your dinner and all teh sudden flash lights and cops. Reason for visit. Known drug area. Yeah lets jump the guy eating dinner, but not the druggies I have called in to report on more then 20 times. Good call. When one of said driggies then started threatening folks, namely me. Three oficer visits and they get mad at me when I ask would they be happy to show up to me being dead. Yeah sarcasm isnt nice, but after three break-ins and no investigation I was loosing hope. I moved , problems follow, cops dont do anything. 17 break-ins later. I had enough and said I am buying a gun to deal with this myself since they wont. Once cop tells me I am inches from going to jail.

Skip two years later. I am at a a relationship break-up. She wants to make sure her leaving doesnt start a problem. Calls police to a a standby. By the time they get there. She now is telling them I hit her. I wasnt asked if this was the case? An important question condiering at the time I had called family to come get my daughter so she canhave a good weekend. On the phone the entire time. Phone records to show it. Cops show up. Guess who is going to jail? I wasnt asked what is going on. Im sitting in a lawn chair at the ned of a driveway. Next thing i know arrested. No rights read. No chance to defend myself. They ordered me to hand over my keys to my car, my home, and hual me off. Two days in their cells no phone call. Met at station by cop who remembers me as the sarcastic ass(his words), procedes to tell me He was hoping I would get caught all us criminals got to start somewhere. Family calls the station. They are told I was sent up to Collin County long ago. Nobody knows where I am.

I was forced to accept a plea deal. I couldnt fight the state. I lost my good name and my riights. I was cleaned out by cop. I came home to nothing. Not one thing left in my home. Even my clothes were gone.

I have never been arrested, I tried to be a cop for Wylie at one point. I served my country honorably, and in one day---gone. I bumped into the arresting officers a couple of years later. They both say yeah we remember you, the guy who got cleaned out, the sarcastic ass our Sargaent told to get. Yeah was funny you crying you didnt do it.

So the moral of the story. If you are a druggie, a person who threatens to kill someone, or a hard working man who carries pepper spray to [rotect himself. Stay out of Wylie. They are inept, morons with guns and a badge. Hell it took a Facebook page for Wylies Angel to be created to catch the person who did that, cause up until then cops had no clue. and lets not even get started about teh child porn case swept under rug for a few of the officers. Of course the only one fired was the civilian women a cop had a relationship with and shouldnt have. All cops no charges. Convenient.

ashamed officer wrote:
As a Texas law enforcement officer of 10+ years, I am ashamed. I am ashamed and embarrassed for this arrest. Officers failed to make a good decision AGAIN. Even more embarrassing is the fact the news stated the prosecuting attorney was "willing" to prosecute. Unfortunately officers make bad arrests everyday. we, as citizens, rely on elected or appointed officials and administrations to provide checks and balances for officers. this failed in this case. as an officer i try not to second guess too many cases because we are not always given all the facts. this case unfortunately screams to be second guessed. I am sorry the obviously "rookie" officer, his fellow officers, his supervisor(s), his chief, and the prosecuting attorney failed you. I am pleased to hear the grand jury did what we rely on them to do. Kutos to the grand jury! being in possession of the pepper spray IS NOT illegal even if it states "police strength". Keep carrying it. As a business owner you absolutely have the right!

To the officer who made this arrest, reconsider your career. We have enough bad and ignorant police, we dont need anymore. Your ignorant arrest makes us all look bad. Since Ignorance is no defense to the law...then why r you not being charged for falsely arresting this person. You should hang your head very low for making a false and ignorant statement of saying it is legal to carry mace but not police strength pepper spray. Carry your penal code in your car AND USE IT before you embarrass yourself and your agency again.

To the patrol supervisor of "mr. i wear a badge so I make up my own law" Shame on you too. you have your stripes taken. the agency must have thought at one time you can supervise or they would not have promoted you. you failed too. U FREAKIN WATCHED THE BAD ARREST...????? WAT THE HELL????

To the Citizens of Wylie, if your prosecutor is an elected offical...UPROAR! demand better or kick thier ass out of office. the next bad arrest and prosecution could be you or one of your family members.

Would love to say I feel better for getting this off my chest but I dont. Still Ashamed. I sincerly apoligize on behalf of every officer who knows this was bad bad bad. I hope you seek civil remedy for this ordeal.
The way to fight this is to go to court and file an action that maintains the law is unconstitutionally Veague. To wit, the law reads:

"14) Chemical dispensing device" means a device, other than a small chemical dispenser sold commercially for personal protection, that is designed, made, or adapted for the purpose of dispensing a substance capable of causing an adverse psychological or physiological effect on a human being.)" Source: http://www.statutes.legis.state.tx.us/Docs/PE...

The lynchpin is the phrase, "other than a small chemical dispenser sold commercially for personal protection" Which a plain reading would be understood that anything other than 1.4 to 3 oz commercially available OC Spray. Additionally,. "Small chemical dispenser" is in and of itself VAGUE and undefined. The fact that people HAVE been arrested for misapplication of law indicates you are exposed to criminal liability for Carrying any commercially packaged MACE, CS or OC SPRAY.

Someone could go to a law library and look up the statue in a law book, which should also list significant cases decided, under that law. The issue may have been decided by this point. Someone got a few minutes to run to the law library first?
