Luke Building Permit Restrictions

As posted in another forum ("what would you pay to live in Surprise") it appears that Maricopa County NEVER lifted the permit restrictions that are in place on our properties due to the proximity of Luke and Aux 1. It looks like what these sneaky bastards did was remove the moratorium and make it PERMANENT! Well, I for one will be filing a claim for 100% of what I paid for my property as the county allowed my house to be built after Dec 31, 2004 and gave me an occupancy permit and never advised me that I could not make alterations or rebuild. I will not use Goldwater because they don't want to file for 100%. It's time to get on the bandwagon again and protect our rights or be compensated.

We taxpayers and voters should be fuming about this. The county has never made notifications about any of this to us. We find out second hand through forums or word of mouth and that is just unacceptable. God forbid any of us have a fire.

When Supervisor Max Wilson said that the moratorium was lifted he also said that building permit requests would be considered one by one and decided if they would be granted. What should be more of a rage is that our friendly neighbors in Surprise, Peoria, Glendale, and from points east to south are paying a Washington D.C. Lobbying Firm Hundreds of Thousands of Dollars to make sure that Federal Legislation will block Arizona Property Owners from retaining full rights to enjoy their property rights. The property owners will hold the note and make payments to the bank on the land but these government entities will dictate how the property will be utilized. Sort of like Russia waging war in to Georgia, a group of hardened artery sufferers have invaded Wittmann.

I was happy when we were advised the moratorium was lifted not knowing that we probably wouldn't get a permit. Do you have an attorney and would you share who that is. We would be interested also.

To all the home owners around Luke Aux #1.Its all about safety and jobs. No you can't build more next to the airfield. Do you want a jet crashing down on your home. Did you not know there was a Luke Aux #1 airfield in your backyard? If anything causes restriction on Luke Aux #1 it could end up closing Luke AFB. That would mean a lot of jobs and money going away. To all the un happy people I say that you should have bought in the East Valley. Long Live Luke AFB!

If you feel so strongly have the county/state buy our homes. They instituted this law AFTER we built.

It is good to have the facts before you chime in here. Many homes were built AFTER the state enacted restrictions. We(our builders) were granted permits for construction AND occupancy permits in violation of the law. Most of us have absolutely no problem with the noise or accident potential and we were well aware that the Luke was there. In my case the builder fully disclosed Luke was there. Signs were posted in the sales office advising of Luke and it's dangers and they had us sign off accepting the noise and accident potential. One of the most troubling aspects of this mess is that a Wal Mart or other commercial structure is allowed in the restricted areas but our homes are not. Now, which is a greater threat, our homes with a few occupants, or a commercial structure with hundreds of occupants. You are right on one count, it's about the money.

Anyone know anything new on the aux 1 no build area? I hear the ban has been lifted but only for pools, patios and fences. Anything on a shop?

I have not heard from anyone that submitted for a permit and was denied. Anyone that was denied should let us all know so we can see what is going on. Some of the homes that are in Peak Valley were permitted way back and their permits were renewed but no one knows what would happen if you applied for a new permit...new home, pool, fence or anything. Let us know your status.

We bought 3 acres in Wittmann about 2 years ago we were so happy about constructing in the area, nobody not even the realtor told us about the problems for getting a building permit, we found out until we went to the office and they told us that we are not allowed to construct, not even a fence to put our stuff since we have some equipment like a tractor,dry van,platform,we paid almost 3 thousand last year in taxes and almost 1 thousand this year just for nothing.I hope this changes in the future and we can be able to do something with our piece of land.

Adan, I posted a report on Nov.2nd,'11. You might be interested in reading it at http://www.wittmannnews.com It will remain available through the follow weekend. Due to space limitations archiving is not always possible with this site. The article discusses a 'new' process Maricopa County Supervisors will begin that actually has been in use but off the records. How the new agreement will affect landowners in the Wittmann area is not clear since a new over lay map has been produced by the Air Force...I am waiting to get my hands on it to see if they took more land or receded the previous zone areas.
