Who would be a good attorney for slander or Def of character? It's time to clamp down on a few individuals! Run your mouth and spread lies, Go ahead but you gonna pay sooner or later.

it would seem that a personal injury attorney would be the best TYPE of attorney to use, but slander is hard to prove especially if its in your own hometown so it would seem prudent to get an attorney out of town...

You would need hard proof before a reputable attorney to take the case because otherwise it's hear say.

In the case of slander, the defendant doesn't have to prove that the statements he made are true; instead the plaintiff has to prove that the defamatory statements made against him are false. In other words, the burden of proof is on the plaintiff.

wrong. if the defendant says he didn't say what he's accused of it has to be proven that he did, and show damages caused by the statements and a judge will decide on the evidence. very hard to prove. The burden is on the plaintiff, always. Slander is verbal, something spoken.

Generally, you have to prove as a plaintiff that a defamatory statement was made, that’s the first element. The second element is that you have to prove that that defamatory statement was published to third parties, that’s the second element. And the third element is that you have to prove as a plaintiff that the publisher (the defendant) knew or should have known that the statement that they made which harmed the reputation was false.

In order to recover any sort of damages ,you’re going to need to prove that a false statement, a defamatory statement, was made which injures the person’s reputation in a relevant community. Because now the question becomes: what is the plaintiff’s reputation before the alleged defamatory statement was published on the internet? If the plaintiff has a really great reputation, then proving harm to that reputation by a statement is going to be easier than if the plaintiff haves a bad reputation already. Therefore, every plaintiff should know if they are going to file a lawsuit alleging defamation on the internet – or defamation of character in some other forum – they have to understand that they are putting everything about themselves, in terms of their reputation and character, into play as relevant evidence. There’s this notion of particular plaintiffs who have such a poor reputation that, in fact, there’s no way to defame them because they’re so notoriously bad anyway. And there’s the notion of a libel-proof plaintiff, where the plaintiff’s reputation is so bad that there’s no way for them to show harm to reputation. Now, most courts handle that in a way that simply goes to weight and credibility, and it don’t automatically throw out bad character plaintiffs out of court because their reputations are already provably bad. For instance, they’ve been in jail for 20 years on allegations of battery or violence , these types of things. It just makes it harder to prove damages.

So in response to that lengthy post. You have to prove which individual made the statement, that it was made someone or public and that the individual knew it was false.

A better and more effective solution is to hit the "reply" button on a given post. Follow the instructions.

Ask the moderator for the name of the poster to support a lawsuit or at the very least, remove the offensive post and do "someting" about the offensive poster. Be patient because it works.

It's too bad that giving someone a good ass whipping is against the law,,reminds me of the definition of Stress:

That condition where the mind overpowers the body's desire to choke the living shit out of some buttwhip who most definitely deserves it..the main thing is to prove that the so-called slander was hurtful and defamatory, and that the person who slandered you had the exress intent of causing such harm..

Good luck, Clay

I really doubt a person begging for answers as to what happened to her missing brother falls under the catalog of slander.

If you are referring to something that was said on this site. It is possible to sue and win against the "anonymous" posters.
Google "texarkana couple files lawsuit over topix comments". There was a couple in Texarkana that sued a hundred or so of the "anonymous" posters and won MILLIONS!
I have the law firms name and contact information.
