An attourney needs to step up and appeal this ruling. Nelly was NEVER arrested for the OVI and her blood was taken which means ARREST. But yet she just walked right out of the hospital and got to keep her license for 8 months. Sounds like a procedural error by the police officer and for some reason when the BAC evidence was admitted Judge Pittman states in her report that the defendant WAS ARRESTED. Of course, the officer admitted under OATH that he NEVER ARRESTED the defendant. HOW COULD NELLY's LAWYER MISS THIS??? Something stinks and it seems like the system is trying to COVER UP the error in procedure which states you must be arrested.

Nelly refused a breath test at the time of the incident, therefore BAC levels were not known till after the state crime lab finished her blood test. BAC report was finished by the state crime lab in April, following federal mandated procedures.
Nelly's indictment was filed August first and Nelly was arrested by the Sheriff's department (not the state trooper) August fifth, 2008. She was in the county jail for 17 days till her family post bond. NO coverup. The girl WAS three sheets to the wind DRUNK. And this was the THIRD time she was caught drinking and driving. The first one, 12-18-2001, she plead guilty to a lesser charge and was fined less than $100.00. The second time was 9-18-2006. Which she plead guilty and received a suspended 177 day sentenced in county jail if she has no other alcohol - driving incidents within two years. This happened within two years. This time she hit another car and killed a lady. Nov coverup.

And to shed a bit more light on the issue with this case. At the time of the accident the EMT report states that there were NOT life threatening injuries to either person in the car. Unfortunately, Mrs. VanHorn developed STAFF infection at the hospital A FACT THAT CONTINUES TO GO UNMENTIONED also the family had a DNR for her. No autopsy was performed on the victim to determine cause of death but yet the papers all say that Mrs.Vanhorn died from the injuries sustain in the accident. Would this woman have died without pulling the plug? The family needs to ask themselves these questions rather than trying to pass blame. Yes a poor choice was made to drive on such a snowy night but after leaving the courtroom I heard family members of Ada remarking how they have also made similar poor decisions and will NEVER drink and drive again. I am very sorry for the Vanhorn's loss but lets get all the facts out and stop the hatred. Or is this just a way to subside there own guilt for their decision to issue the DO NOT RECUSSITATE notice. If blame must be passed then blame the hospital which allow Mrs.VanHorn to get a STAFF INFECTION.

YES, There was an autopsy done and it clearly stated that Mrs. Van Horn died from her injuries sustain in the assault. There was NO Staff infection in Mrs. Van Horn. Where are you getting your information Hammer?
Rather than trying to pass blame on a 'snowy night' as you called it or Mrs. Van Horn's family the blame belongs placed on the drunk driver who has owned up to the cause, apologized and admitted guilt.
YES, Lets get all the facts out and stop the hatred and misinformation.

I did a little snooping. Who exactly said those words, because their saying your not just twisting words but making some up.
Also, I've noticed that you and Nelly were in the same pool league. In fact from what I've gathered, Nelly was at the bar that night to play pool.So tell me Hammer, How many drinks did she put away that night and how many did you buy her?
Were you by any chance celebrating your birthday?
You seem to be trying to blame everyone else for this. Why? Nelly admitted her guilt. You wouldn't be trying to compensate for the guilt you feel would you? After all, maybe if you had said something or ordered a cab the crash wouldn't have happened and Ada would still be alive!
I have to ask, This is the third time Nelly was caught drinking and driving in about seven years and someone died as a result of her latest "mistake". She's been sentenced to five years. Lets face reality, Most likely the prisons will need to be thinned out due to over crowding and Nelly will be released early. With that in mind, How much time does she deserve to serve?
By the way, you never said how you found out Ada had a staff infection. You claimed it as fact so back up your words!

If you really believe that then why not throw away your money and pay an attorney to appeal the ruling for Nelly? Since Nelly and her family don't seem to have much money it wouldn't surprised me if you help cover some legal fees already. Even if her family did have the money to pay an attorney to appeal, her other siblings have trouble with the law to deal with.

Get a life and your facts straight. If I was there NONE of this would have happend PERIOD. GOD is the only one that can judge and he will forgive Nelly for a poor choice which resulted in an absolute tradgedy for everyone. Will he forgive you for all the hatred? Only God knows that one....

Amazingly, NELLY DID NOT try to get the case thrown out of court due to a tecnicality.....
the defendant only cared about the well being of both families that were affected by the accident and NOT how she could get out of it.....
AND THE KICKER:
I heard the conversation as I approached my car…… they were discussing how they were not drinking anymore……. It was then that I realized that most people, including these two men, drink and have been behind the wheel at one time or another when they should not be…… Sadly not many think of the ramifications until after a tragedy like this happens. We hear about repeat offenders all the time…… WHY????
With Mrs. Vanhorn now in heaven, I know Jesus will show her how to help her family forgive and put his love back in their hearts instead of the hatred that is consuming them.
GOD is the only one that can judge and he will forgive Nelly.........
Where's the hate Hammer? Instead of owing up to your own responsibilities of that night, You have accused the court system, defense lawyer, the law enforcement officer, the hospital, the medical examiner, the victim's family's emotions and decisions, what you over heard, what you might have over heard, what you think you over heard, what you wish you over heard and snow for this wreck. You have accuse everybody else possible but yourself. Cut the lies and accusations and apologize.

uhhmmm... Hammer, Who's hating?
I'm not buying what your selling. You've attacked the Van Horn family because of the DNR, Yet you call Nelly drinking and driving a mistake.
If Nelly had been drinking the crash won't have happened!

A Trumbull County woman was sentenced to five years in prison Wednesday, stemming from a February 2008 crash that left an 80-year-old Randolph woman dead.
Nelly J. Warren, 32, of Southington received the sentence Wednesday from Judge Laurie Pittman in Portage County Common Pleas Court.
Warren had pleaded guilty Nov. 25 to one count each of aggravated vehicular homicide, a second-degree felony, and aggravated vehicular assault, a third-degree felony.
The charges stemmed from a Feb. 21 crash on S.R. 82 in Windham Township that seriously injured Ada E. VanHorn, 80, of Randolph, and Patricia V. Quick, 52, of Windham.
VanHorn died of injuries sustained in the crash about one week later.
According to previously released information from the Ravenna Post of the Ohio Highway Patrol, Quick was driving westbound on S.R. 82 around 10:10 p.m. when her vehicle was struck head-on by one driven by Warren.
The patrol said Warren was eastbound on S.R. 82 when she lost control of her vehicle and crossed into the opposite lane, striking Quick's vehicle.
The patrol said alcohol use by Warren was a factor in the crash.
In addition to the five-year prison sentence, Pittman also ordered Warren's driver's license suspended for the rest of her life.

nelly is a good looking girl and she made a mistake and shes paying for it now. the family don't really blame her if you read what they said is that they hope she gets 8 years not beacause they want her to just so she can get a college education and come out something instead of getting out and doing it all over again so don't pass judgement people make mistakes everyday myself included there is no one to really blame here its a tradic accident and maybe something good will come out of this who knows.
